Excel Parking finally take someone to court over an unpaid 'parking ticket'..and LOSE

Please don't confuse debt collectors with bailiffs. The former are just powerless individuals with no more powers than you or me to demand money off people. Bailiffs would only come on the scene if the case goes to court (very unlikely) you lose (very, very unlikely) and then you refuse to pay whatever the court orders within 28 days. Only then would you credit history would be affected.What part of "A whop bop-a-lu a whop bam boo" don't you understand?0 -

Today i received a Notice of intended litigation letter from a solicitor and not fro excell directly.
Can this still be ignored?Starting Debt (October 2008) - £10928.27
Feb 2009 = £8419.21 (12/02/09)
Now = £2867.39 (27/06/11):cool:

I've read the advice, which in the main seems to be to ignore these private parking tickets.
However, having a genuine reason for appeal, it goes against the grain to do nothing.
I received a ticket this week. Our car is registered to me, but my husband was the driver, I was at work. At this particular car park there are 2 ticket machines. He tried to get a ticket from both, but both machines would not accept the money - it kept coming back out. Not realising that the car park is enforced through cameras taking footage as you enter and leave, he left a note in the car (for any inspector) to read to explain. He also saw another driver having similar problems.
Having read all the threads I doubt whether the company would even take any steps to investgate the appeel. But to ignore doesn't seem right. In the very unlikely event that they took us to Court, it would not look good to say we just ignored it - if we did have a genuine reason for appeal.
I'm thinking of writing to say I was not the driver, that I've spoken to the driver who tells me both machnes were not working and leave it at that. I would not provide the driver's details and not give any further information other than details about what the 2 machines did (didn't do) on the day.
What do others think?

If you look through the forum index you'll see theres a parking forum,as you've posted in the wrong section we're going to "fine" you £50.
Will you pay it? I doubt it.So why worry about the parking co when they have the same level of authority as us? ie;nowt.Went shoplifting at the Disneystore today.

Whilst the chances of excel taking it further are remote in the extreme, you may be right in appealing and then ignore after they reject it. As you say you tried and got rebuffed. They have already spent £2.50 finding out who you are so you don't save them anything by confirming who the RK is. Just send it in third party grammer, the car was parked, the driver did etc. Do not say who was driving though.I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.0 -
I have just had a phone call from Graham white solicitors infoming me that they are taking me to court over unpaid Excel parking ticket. on the ticket it has no time of issue and on the letters sent to me they have the time of issue as two different times the are now threaterning to take me to court and gain a warrant for the removal of my car which they will then sell at acution to recober the cost Car worth £8000 ticket cost £143 can they do this0

Quite simply no no and no.
I take it if they have rung you, you have provided them with your contact details and they now have you in the keepnet. Dont engage in any dialogue with them whatsoever, you have simply triggered the next stage of the scam. If you dig into Graham White Solicitors you will probably find its Excel masquerading as a "solicitor"
Suprise suprise see what google brings up if you google them - scam parking claims! (Cant post the link so see for yourself)
Only council's or the policy have the power to impound or remove property. This is a civil case on which they have no leg to stand on. DO NOT engage in any more dialogue with them!0 -

How much would the correct fee have been?
They stand no chance of getting a judgement for the penalty part of the fee.
If your car is not on their client's property then it is extremely doubtful that they would get a judgement that would allow them to take your car.There are two types of people in the world: Those that can extrapolate information.0
