Not exactly true. The law states, and I quote

363 Licence required for use of TV receiver
(1) A television receiver must not be installed or used unless the installation and use of the receiver is authorised by a licence under this Part.
(2) A person who installs or uses a television receiver in contravention of subsection (1) is guilty of an offence.
So if the TV is installed, and you are not watching it, that IS an offence. The definition that TVLA put on install is that the television receiver is connected to the sky box/freeview/aerial or whatever. If its not then they cant do anything.

Basically, if you do not watch television programmes as they are being broadcast, then your television is not "installed or used for the purpose of receiving television programme services"
The definition of 'installed' is not just plugged in. You have to actually watch these programmes for the television to be considered as "installed for the purpose of receiving television programmes".
If you do not watch programmes as they are being broadcast ('live' broadcasts) then you do not need a television licence.0 -

i do not watch live tv at all! i watch tv via the internet you tube and 4od ect so i dont have a tv licence but my bother is about to move in with me while the concil rehome him. most of his things are going in to storage but he wants to bring his tv to play xbox not to watch tv. i dont know if that means i need one or not. i have a friend who got a fine coz she had a tv with no licence, i mean if they knock on and see a tv they will just fine me wont they they wont ask if im watching it... i have just got my 1st home so i havent had a vist yet but if they do come im willing to let them in do they have to look in all your rooms? i mean i dont like the idea of ppl in my bedroom snooping around.
also is there really a phone that you can get live tv on? and then what ur phone is normaly in ur bag or whatever they gonna hunt around ur house?0 -

It has all been said on this and other threads, if you really do NOT watch LIVE TV as it is being broadcast, (including LIVE TV on the net or phone), then you DO NOT need a licence.
From TVLA site (my highlighting): - "You must be covered by a valid TV Licence if you watch or record television programmes as they're being shown on TV. It makes no difference what equipment you use - whether it’s a laptop, PC, mobile phone, digital box, DVD recorder or a TV set - you still need a licence.
You do not need a TV Licence to view video clips on the internet, as long as what you are viewing is not being shown on TV at the same time as you are viewing it.
If you use a digital box with a hi-fi system, or another device that can only be used to produce sounds and can't display TV programmes, and you don't install or use any other TV receiving equipment, you don't need a TV Licence.Don`t steal - the Government doesn`t like the competition0 -
i understand that but mr tv licance man will just see a tv and fine me wont he? do they have to see it pluged in the arial or something? also what if ur at someones house like babysiting or something and they knock on then. you can just tell them its not ur home and they have to leave right? seems unfair if u dont live there im not sure who would get the fine eather coz u have to fill in a form.0

It can't be explained any easier! You do NOT need a TV licence to OWN a TV, just to watch LIVE programmes as they are broadcast!

The TVLA employees who come round have NO RIGHT OF ENTRY to your property, say nothing and close the door on them.

i only babysit my sisters son any way he has a wii so i wouldnt have a chance to watch tv lol very glad he dose tho. they need to buzz to get in the billiding any way but i thought they could get a warent.mind you he wont be hear that long any way then they can come and check my sock draw if they must lol.0

Your definition of install is incorrect.
It's not my definition, it's TVL's.Now, lets quote the LAW again, and see if it says "use" or " installed or used"
When you say quote the law, you actually mean "quote two lines of the law, out of context with the rest of the law" which renders the quote meaningless.
Please read my link which includes letters from TVL that explain their position on this and also clarify the definition of 'install'.
