  • I've just seen a new article on the MSE website about TV licences that says

    "Everyone who no longer requires a TV licence - including those who pay in cash at certain stores or Post Offices, who don't need to do the above - needs to fill out a No Licence Needed declaration form. After this, make sure you keep your confirmation email from TV Licensing as proof."

    I'm pretty certain that this is the opposite of the case.

    You do NOT have to tell them you don't have a TV, or give any reason why you don't have a license. You need a licence to watch live TV. It's the law.

    There is no legal requirement to do anything if you don't watch live TV (even if you have a TV set), any more than you need to tell the police that although you have a sharp knife, you haven't stabbed anyone this week.

    If some new legislation has been brought in that does require a "no TV" notification, this has passed my notice, so I'd be interested to know what and when.

    If it hasn't, why is MSE giving misleading advice?

    To be fair to MSE, they may well have consulted BBC/TV Licensing and were probably given the misleading information by them. BBC/TV Licensing do not seem to grasp the distinction between things they'd LIKE people to do, and things people MUST do.

    They'd like people to complete their on-line form. People are not under any obligation to do so.

    Remains exactly as it has been since 2003? (There's been no change to the Law).

    In what way?

    If you watch/record live TV, then you require a licence.

    That's all 363.1 says.

    As non-live TV watchers (or, in my case, as a non-TV watcher) we are complying with 363.1, and indeed, the rest of the Act.

    as it clearly states "a person" , is it the property or the person watching?
