    Yep, got my refund thru today too - although I couldn't be a***ed asking them for a discount voucher as I very much doubt I would buy anything from them again.

    Although no confirmatory email has been received, the £1.47 has been taken from my CC.

    If they take money from your card the contract to supply goods is binding isn't it?

    I think this is one of those things where you are correct but you ave to take them to the small claims court to get justice. Basically your'e on your own.
    The discount voucher was for the lordly amount of 5%, as most of their prices seem to be R.R.P. I don't think I'll be using it but it was the principle that counted.

    Did I really expect to get 50 DVDs for 1.47 - no.

    Did I really expect to get a brush off, that would appear to drive a coach and horses through their legal, moral and sensible business practices to such an extent --- no, also.

    With 20 mins spare, I sent them the following - and as a point of principle, I would suggest that everyone let down do something similar. As the owner of a retail website, I employ a 24 hour watch to ensure this kind of debacle never happens.


    Well, thanks at least for a reply.

    Without wishing to waste further time, I would make the following
    observations:

    1) Your "terms and conditions" are almost certainly unreasonable, and
    hence unenforceable.
    2) Whilst accepting the concept of "wrong pricing", this hardly
    applies if you continue to accept orders when you have realised your
    error - unless your attention to order value and quantity is
    negligent - in which case this defence fails.
    3) Your offer of a 5% discount is one which most people will find insulting.
    4) It seems to me that it's most unlikely that these DVDs are not
    available from your supplier.
    5) Given the choice of DVD suppliers, I think your whole attitude to
    this mistake will just further tarnish your somewhat poor reputation
    - when you had a real opportunity of turning a mistake into a
    valuable source of new customers.
    6) I buy around 2 DVDs each week. Whilst you email me your long,
    boring, and probably unenforceable excuse - no doubt with a somewhat
    smug feeling of legal overkill - it's just so easy for me to not
    ever, in any circumstances, ever order any product from you, ever
    again. And also tell my friends how shabby your service is. And post
    to "moneysavingexpert", Ciao, etc,etc, just how I rate your service.

    Anyway, congratulations in your method on resolving this problem - it
    tells me all I need to know about your company.

    For what it's worth, even if I accept this was a genuine mistake, in
    all the products I have ever bought on the internet, your company is
    by far the most shoddy, amateur and unprofessional I have ever come
    across. I wish you and your apology for a company the success you
    deserve.

  • They took the £1.47 from me on the 7th and I got i back on the 9th... Fair enough.

    Really, I promise, these things normally don't wind me up.

    However, their snotty "non-aplology", combined with a whole load of legal garbage - ie they couldn't get the stock, and in any case had mis-priced, and in any case hard luck because of their terms and conditions, have just a tad got me going. All this and their encouragement for me to contact Jersey Trading Standards...........

    Well, I don't much care about the videos now. But I really don't like being treated like a muppet.

    So, just for the price of a stamp, I'm going to give it a whirl, on the basis -

    1) I don't believe they can't get the stock.
    2) It's fair enough not to supply if you have wrongly priced - but in accepting payment, you enter into a contract, which can't be just "undone" with a refund.
    3) Their T&C's are completely unreasonable, and hence unenforceable.
    4) I just don't like their attitude.

    Anyway, despite all this, the great enthusiasm with which they suggested I contacted Jersey Trading Standards suggests they've wriggled out of this situation before.

    Not, I think, a great advert for them, and when I get a response I'll make sure to post it here - just for interests sake!

    Yep, I totally agree, it was obviously coming.

    But there's a way of dealing with a complete balls up, and a good way of doing it is rolling over and saying sorry. I personally run a website, and practical stats show me that if I make this kind of !!!!-up, and deal fairly, quickly, and honestly with the punters - and in this case that would not include agreeing to supply 50 DVDs for £1.47 - but making them an alternative, and probably loss making offer, these people will become among the top 80% of my customer spend within six months.

    If I treat them like muppets, there is almost no end to what the minority will do in amazingly creative attempts to f**k up my business.

    I personally think that the above is going to be your problem here - because you knew that it was a misprice when you placed your order.
    If the ordering system on your own website fouled up and resulted in 100s (perhaps 1000s) of erroneous orders on which the price paid would barely cover the postage, and would possibly put your business 'in the Red' - which would possibly threaten the safety of your staff's employment - wouldn't you try to get out of supplying the orders too? I think you forget how many people this forum reaches, not to mention tips from here being carried over to RPoints and who knows how many other bargain sites, plus word of mouth.

    That said I do think that they should have faced up and told you straight that the items were misadvertised, but even still, you have your money back, why not just let it lie and use your energies in a more positive and productive manner? :cool:
