Excellent defence, you will not only get off on the "over zealous" policing angle, you will receive millions in compensation as you have hit on the defence which nobody ever considers ? That is the speed limits do not apply 24 hours per day and "as a charity I take drunks home to clear the town centre and never ever charge them money or make a living from it."
Brilliaint, totally brilliant, will love to see you have your day in court, the magistrates will really fall for this one ; )
The guy who killed 7 and himself also was only pinching a little bit of speed, and it was also very quiet on the road, except for the car he hit ?
But his speeding was totally and utterley different to yours, as you were a taxi driver flying back, oops crawling back in to town to pick up another poor drunken destitute fare as a public service, because taxi's dont fly round at night, or do they ?0 -

Where does the law say the police can only prosecute speeding offences if they have a camera ? I bet one of them had a camera phone, won't that do ? :rolleyes:
God your absolutely right, can you remember the 60's when the police cars used to have the photographer standing on the roof rack with the tripod mounted on the roof, and the little yellow birdie on top, with the cameraman holding the flash ? those were the days :rotfl:0 -

People get caught out every day, fact of life ?
So why whinge and whine about it ? OP doesnt like the law applying to him, he wants it applying to people travelling faster then him.
People caught at 10% + 2mph want the law applying to people travelling faster then them, which he was.
Who will ever be happy about being caught out ? most people speed on every journey to one extent or another, so he gets caught out this time, why not celebrate all the times he hasnt.
Whoops nearly forgot the revenue angle, everyone knows the cop has to make 30% of his/her salary from speeding tickets, and 5% goes into the xmas fund. Plus ...................
He talks of a drunk wandering around the road, which happens a lot and he still decides to speed. He works nights which a lot of people do including myself, so whats the point ?
Whats the point of having 24 hour laws when you only want them to apply to others and for only so many hours a day ?
The A429 fatal shows why traffic cops should be around as a deterrent and people should expect them to be on the road and not suprised because they have attacted attention to themselves, also if there had been more traffic cops around, possibly circumstnces may have been different, but to then belittle their role because it was applied to him as a taxi driver ? whats his point.
Taxi drivers are not saints and public servants, they just do a job like everyone else and are covered with the same responsibilities and the same laws as 9 x 5 workers.0 -

You are getting confused between the OP, Spuddy who asked nothing more than how does he ensure he WAS guilty, or not innocent of speeding, and the Silverfoxguy, who thinks for totally differing reasons that the law only applies at certain times of day or exempts certain proffessions? Apologies for any confusion, I was not addressing Spuddys predicament, as his can be resolved either by the documentary evidence available from the police, or his own honest recollection of the day ? If in doubt he should plead not guilty if he believe he is not the driver, then he must name the driver of his vehicle at the time, however, I dont believe this is the case, just purely whether there is an avenue for him to avoid prosecution.
My reply was to the taxi driver post and basically why should the police give taxi drivers exemption from speed limits ? what makes them expert or skilled driver? nothing whatsoever, they undergo no test or training etc.
My experience of taxi drivers has always been with concern late at night as they are trying to increase their business by a quick turnaround of passengers, and the view that they are helping the police clear drunks, doesnt wash, laddo gets a taxi and clears off, or gets locked up ? end of game.0 -
I would not like it any more than the next person. If I was caight and I know I was inside the speed limit I would contest it and argue every bit of the way. But be honest I know when I am speeding and if I get caught I will have to suffer the consequences. Then you're obviously not aware that the devices known as LTI 20/20's (which clocked me) are banned thoughout the USA because a defence lawyer obtained one, used it across the courtroom on a laminated sigh and managed to ascertain the stationary sign was doing 8mph.
I'll bite the bullet on this one, I'll write to the inspector and plead that I thought it was a 40 zone and see if I can get off with a speed awareness course instead.
You weren't stationary though, nor are you a laminated sign. You'd still know if someone went past you at 42 in a 30 zone thoughIt's taken me years of experience to get this cynical0 -

1) In the OP's case if he was doing 42 mph then he was 'way above the limit' - 40% by my reckoning.
2) It's not entrapment in any way, shape or form.
3) If I took receipt of your letter that you posted I would laugh and throw it straight in the bin. You were caught and you were guilty. Take it like a man.0
