Speeding Prosecution...?
Hi,
Never been in trouble with the law before ever, not so much as a parking ticket. Anyway today a letter lands on the mat Notice Of Intended Prosecution. It is regarding a supposed speeding violation that was caught on camera about a week and a half ago. I was indeed driving, but would like to know what my rights are. I have logged into their website and the picture is so far away that nobody can be seen inside. The pictures watermark states 149.7 metres away. Also the gun used to "trap me" was last calibrated on 28th March 2007, almost a year previous. Considering I rememeber the day in question, I had my partner and my mother in the car i'm very dubious about the intended prosecution, without totally saying im innocent.
Does anyone have any advice that would help me in this matter, or refer me to somewhere that could help?

They have up to14 days to issue the NIP, and they probably included the calibration details as this is a good get off clause as it needs to be done every year.
Does anyone else drive your car? is it definatley you?
What speed were you doing in what sped limit area?
Any chance you were distracted by talking to the other people in your car and let your speed creep up?0 -
Hi Spuddy, for further links see Part 6 of the Motoring Websites thread - I'll move this to the Motoring Board
Hi, Martin’s asked me to post this in these circumstances: I’ve asked Board Guides to move threads if they’ll receive a better response elsewhere(please see this rule) so this post/thread has been moved to another board, where it should get more replies. If you have any questions about this policy please email abuse@moneysavingexpert.com.0 -

Interesting one about the calibration though, 12 months previous, can't imagine that can be legal can it?
Also OP has honourbly made it clear he was driving so the only thing in question is the legality of the equipment.;)I like the thanks button, but ,please, an I agree button.
Will the grammar and spelling police respect I do make grammatical errors, and have carp spelling, no need to remind me.;)

You had 2 women in the car at the time? it's no wonder you couldn't concentrate on the road with them yacking at 700 miles an hour, not that I'm saying you actually were speeding of course cause I wasn't there but I know what it's like with 2 women passengers in the car.Winnings

It's not only the calibration certificate it is also required to do a test run before and after the session. Also the presence of other cars near to the target vehicle. The degree of exposure of the vehicle wheels to the front.
But fighting these things in court is IMHO reserved for the rich who can afford to lose and who can afford the best lawyers. The "Hamilton defence" worked for the hamiltons and a police chief inspector, but is unlikely to work for Joe Public and frequently doesn't, moreso because the magistrates usually always convict and you have to appeal to get a proper hearing - i.e. not a kangaroo court that us plebians have to deal with because we can't afford a proper court.0 -

Thats only for hand held/police operated/scamera van units tho isn't it? This could be a fixed installation, the OP doesn't say?I like the thanks button, but ,please, an I agree button.

I don't want to be Mr Annoying..... But if you were speeding and you got caught...Pony up the dough, accept your punishment and don't get caught next time. The 3 points are unlikely to affect your insurance too much.
Unless you were really well over the limit and have to go to court?
By the way how many MPH were you over the limit?NO to pasty tax We won!!!! Just shows that people power works! Don't be apathetic to your cause!0 -
Hi,
Thanks for all the responses. I have posted on pepipoo.
I am aware of a number of things that I can request. (1) Pictures/Videos taken, (2) proof of calibration before and after the tour of duty, (3) proof that the device had a calibration sticker affixed and had intact lead seals to prevent tampering.
Of course, other than the pictures/videos of the alleged offence, the rest will probably be denied. The general concentious is that I haven't got a hope in hell unless I have deep pockets then?
For the record, I was allegedly clocked doing 42 in a 30 zone by a mobile camera. It was almost 150 metres away. I'm not prepared to go to court because the cps will favour the law unless I have thousands to spend on a lawyer and device experts.0
