The points have been awarded due to purchases made the transactions are over and complete the points belong to the holder of the card, the card is merely a device by which the holder redeems their points and does not represent the points, if the card holder is deprived of the card then access to the points must be made by other means, if the cardholder is not permitted to visit the premises without fear of prosecution the cardholder is therefore permanantly deprived of the points, theft!

If they do surrender the points then clubcard deals may be purchased without actually visiting a store and facing trespass, but then again the cardholder may not have enough or may have left over points that do not make up enough to exchange for a deal so back to theft.

I do find it funny that you should accuse me of posting nonsense, and then go on to post completely inaccurate rubbish yourself! :rotfl:

According to the Air Miles terms and conditions:
"You are the holder of AirMiles and are responsible for their security. We are the owner of all AirMiles and they remain our property at all times. Each mile can be changed for 0.001 pence and you must change at least 25 pence worth".

    From Nectar:
"If a Nectar Account is closed everyone’s rights to redeem Points from that Nectar Account are lost".

    And from Tesco:
"This voucher is and shall remain at all times the property of Tesco Stores Limited. This voucher has no cash value".

So in other words, it is not theft as you claim, because you cannot steal what is already yours! Perhaps in future you should do some research before posting such rubbish!

Is there any need to be this rude? It's comments like this that will close the thread down, and I thought the purpose of this thread was to help igloo out.

As a primary school teacher, I find "He started it" an unacceptable reason.

Disagreements are never an excuse for rudeness.

I do not believe my comments were rude at all - I was simply correcting what Ben had said, and advising him to check before he posts.

... I don't necessarily think you are deliberately lying just a bit blinkered and extremely thick!

I do however, beleive that Ben's earlier comments were childish and rude, and nothing more than a personal attack on me.

With regards to helping igloo out - I believe she would be wasting her time if she followed Bens advice to persure Tesco for theft of Clubcard points. Igloo needs help and advice which is correct; wrong information helps no-one.

I don't recall if Igloo is banned from just that Tesco, or all of them?? I would assume it's just that one, and as such, she might want to use another Tesco....and her clubcard. I don't see what the clubcard has got to do with the store in question and think it should be returned / reissued allowing her to use her points as normal.

Need I say anymore? Else they'll be a spell on the naughty step for both of you...

It probably depends if there is any Head Office involvement in the banning process. If is it simply a case of one store saying you are banned, then there is probably little to stop you going to another store, and keeping your clubcard points.

If however HO have blacklisted igloos existing clubcard account, then she probably needs to register a different address and start a new clubcard account. (Assuming of course igloo wants to carry on shopping at any Tesco)!

Which for me is the key thing. If everything happened as described - and I'm not doubting that, just being realistic that we've only heard one side of the story - why the bl**dy h*ll would Igloo wish to continue to do business with them?
I really must stop loafing and get back to work...
  • I agree that Igloo should either see a solicitor for some advice or better still, (and free) take the matter to Trading Standards.

However - it is NOT a police matter. Therre are no criminal offences with what she has descibed. It is entirely civil.

Of the two options, I would urge you to involve Trading Standards - it is they who can take up the case regarding store policy and head office policy being muddled, and also the complete lack of policy on display in stores for customers to be aware of.

Unfortunately being badly treated by ignorant staff is not enough in itself to take them to Court over.

You best bet is to see what trading offences, if any, there are by them seemingly making up policy as they go along - and the complete lack of making it visible to customers.

The experts on this are Trading Standards.

Just got back from a week's hols and spent ages on this thread catching up.
One thought has occurred to me - has Igloo checked her home insurance policy? Quite often people have a legal advice helpline included which allows you to phone up and speak with a solicitor, and they give both advice and help.
I suggested this to a friend when she had a problem with Curry's over a fridge and the solicitor she called (she didn't even know she had access to this until she checked) was very helpful and wrote a letter to Curry's that got it sorted straight away.

Had a phone call from the store manager of my local tesco today, as promised, and apologies for being a bit late (sorting out floods yesterday). He has confirmed the policy and is happy to take unique coupons if I haven't bought the product so long as they are in date and stocked by tesco. He said there were no limits so if I had enough coupons I could pay for my entire shop. He stated no change would be given from coupons.

This seems entirely consistent with the oft quoted policy where no mention is made of limits being imposed. The only addition being no change given - but I would hardly expect that.

Furthermore he has emailed all the stores in my area to inform them of the correct policy (I guess because he has expended his time in sorting it & is being helpfully proactive). He's even asked for it to be communicated to all Tesco stores. I'm moving in a few weeks and will appreciate not having to go through all the hassle again.

Top marks for Mr. Tesco Portsmouth.
