Also bear in mind the advice you may see on here is quite often biased (mine certainly is) and if I was involved in any way with on the other side of this incident I would advise you to walk away and forget about it because its your word against theirs lack of evidence lah de dah de dah.
See a solicitor BEFORE you make any decision is the best advice I can give, anybody telling you there is no case to answer here is either misguided themselves or perhaps deliberately trying to misguide you!Four guns yet only one trigger prepare for a volley.Together we can make a difference.0 -
igloo, if I was the victim in this situation and had just received the letter you had, I would already have spoken to a lawyer, the police and every media outlet I could interest in the story. However, I sense that you are not comfortable with the attention and hassle that type of approach inevitably attracts. That's perfectly fine and understandable, but I suspect that Tesco sense this too (as I'm sure someone from that organisation will have carefully read this thread) and their approach seems to be based on the assumption that you will give up now.
Speaking to a lawyer will at least appraise you of the options available to you (in civil and criminal courts) but does not commit you to take any action other than that with which you are comfortable. Many will give initial advice free or there may be someone legally qualified at your local CAB who could give you impartial advice and support. CAB may even pick up the fight on your behalf. If you have the heart for it, I implore you to at least explore the legal remedies available to you. Tesco should not be allowed to walk away from this.There's love in this world for everyone. An important source of free advice for you would be your household buildings and or contents insurers as most policies carry legal advice, this service is provided free of charge (It's actually calculated into your premium) the number can be found on the inside cover of your policy booklet or provided by any call centre number you have for your insurance company, if you have either policies or even both then consult your booklet for instructions, if you want you can simply pm me with details of the company you are insured with (no personal details required just the name of the underwriters of your policy I can then scrutinise the policy for you) and I will check out the cover that applies for you, if you are unsure if you have such cover a quick call to your insurers and ask to be put through to the underwriting dept they will confirm exactly what cover you have and supply any contact details. If your contents policy and buildings policy are held by different companies you can consult both and compare the advice given, this may well be the best option for you as it can all be done over the telephone as all calls are recorded in most cases you won't even have to complete a form. Don't forget you have already begun to create a paper trail documenting details for reference or to substantiate a claim, take a little time to look back over things it will help you to reach a decision best suited to you and your needs.Four guns yet only one trigger prepare for a volley.Together we can make a difference.0

And don't forget the clubcard may belong to Tesco but the points belong to YOU, they are your property and can be requested, again if you are banned from the store then you can hardly spend points there so an equivalent cash value should be offered in order not to deprive you of what is rightfully yours.Four guns yet only one trigger prepare for a volley.Together we can make a difference.0

Don't know about the points themselves, but to quote on the back of the vouchers;
1. This voucher is and shall remain at all times the property of Tesco Stores Limited.
6. This voucher has no cash value.
If the vouchers are held in e-form
8. The terms and conditions above do not apply to Tesco.com eVouchers. eVoucher terms and conditions can be found at https://www.tesco.com.
I've got better things to do on a Friday night so won't go and trawl their site, but wrt (8) I'm sure there'll be similar T&Cs on their website somewhere.I really must stop loafing and get back to work...0 -
The points have been awarded due to purchases made the transactions are over and complete the points belong to the holder of the card, the card is merely a device by which the holder redeems their points and does not represent the points, if the card holder is deprived of the card then access to the points must be made by other means, if the cardholder is not permitted to visit the premises without fear of prosecution the cardholder is therefore permanantly deprived of the points, theft!
If they do surrender the points then clubcard deals may be purchased without actually visiting a store and facing trespass, but then again the cardholder may not have enough or may have left over points that do not make up enough to exchange for a deal so back to theft.Four guns yet only one trigger prepare for a volley.Together we can make a difference.0 -

Value your opinion, but read what the terms and conditions on the back of the vouchers actually say. I'm not referring to the card, I'm referring to the T&Cs on the vouchers themselves, which clearly state they remain the property of Tesco and have zero cash value.I really must stop loafing and get back to work...0 -

Wasn't meant as a critique bunk just a rationalisation.
