    I've read and re-read the OP's account of events and still cannot see any possibility of where Tesco is culpable for any sort of negligence, other than that of negligent customer service, for which there is no law to govern standards of.

    Someone mentioned cash compensation.... for what exactly? What damage has been caused? A tort can only be made out against an organisation if there is quantifiable damage.

    If I was Igloo, I'd go hell for leather in chasing Tesco down for an apology, some ex-gratia points and a clarification in coupon policy.

    As to the question of trained solicitor aimed at me, it is correct that my specialism is corporate law and not consumer or criminal law. I will give way to any such lawyer with better knowledge in this area than I do.

    After spotting 8 different errors on a few shelves of cheese today I decided to write out a few of the suggestion forms whilst picking up a clubcard deals brochure.

    1) Please check your prices better.
    (one of the mistakes was one I'd had refund and replace on a week earlier & price removed)

    2) Clarify (national) coupon policy with HQ, train staff accordingly and display the rules in-store.

    ........it was then I found the slot to post the forms into was sealed up. There was a big queue at CS where I guess you hand them in (somewhat not as anonymous as I'd like) but I very nearly wrote a third suggesting that they unblock their suggestion box. To me that was a demonstration of what they say.....and what they do.

    Just thought of something... did you have any witnesses? Tesco could say that nothing happened and you are making it all up...

    Good luck with it all and keep your chin up as you are much better than a faceless giant feeding us all overpriced, poor quality food....! I'm not a Tesco fan as you can tell!

  • I would want a damn sight more than coupons, esp if my children saw me in that situation.
    Go see a solicitor on a free session (most offer an hours free consultation)

    I agree with most of the comments. The heavy handed approach clearly amounts to intimidation, harassment and false imprisonment. If it was me I would report the matter directly to the police and lodge a complaint.

    Reasons

    1. You did not do anything illegal
    2. You were treated as a common criminal
    3. You were assaulted – check the definition of assault as it clearly states “fear of death or injury to you”
    4. You were humiliated
    5. There were several witnesses including the checkout girl who could confirm your story along with the CCTV footage. If they have deleted it, clearly they are hiding something.



    In addition to criminal charges I would be pressing for civil damages also. In other words you are looking at a tidy amount of compensation and tesco’s is looking at the worst possible PR disaster.

    Even if you don’t press charges, make sure that you write several letters (to the senior management, and also to their PR office) make sure that you send them via recorded delivery and mention that if this is not settled in a suitable manner you will be passing the info to the press.

    Don’t let these big companies intimidate you….. as a consumer you haven’t broken any laws nor have you broken any rules of Tesco’s., clearly a no win situation to Tesco’s.

    Let us not forget that under vicarious liability Tesco’s is responsible for the actions of its staff, even if they have exceeded their authority.

    A good lawyer (if you can find one) is looking at a field day!

    oh for godness sake, where on earth in the first post did it say there was either of those things. :eek:

    the advice being handed out here in some posts by uninformed bystanders is all getting rather out of hand :mad:

    and you've all only heard one side of this story anyway :confused:

    I have just sent a stinking e- mail to terry leahy(at least I hope that I have as my computer is wonky).

    Told him exactly what I think of the appalling examples of customer treatment-mentioned the MSE thread and the fact that I had intended going in there this afternoon for school uniforms and birthday presents but feel very wary now and willl probably not bother!

    Can I suggest that everyone else does the same:mad:

    Lets tell them what we think about the disgusting way they treat customers:eek:
