  • That would depend Wasp..have you been paying them while NOT paying anything to your other creditors?
    If so, then yes it could well be a problem and the OR has the right to recover the money from your friends.
    If you've still been paying your other creditors whilst paying your friends then it should be ok.

    I only stopped paying creditors a month and a bit ago, since then i've had one payday when there's a large cash withdrawal.

  • Right, i'm not sure where you would stand then.
    Can you afford to pay your creditors anything..even a £1 payment?
    Have you contacted one of the free debt charities?

    Hopefully someone else will help you a little more with this.

    Yes I contacted CCCS and had my interview with them over a month ago, this was when i stopped paying my creditors (as they advised me to go bankrupt) but had one payday where I didn't pay "official" creditors but did pay my friends.

    Any chance someone could take a look at my I&E and see if i've missed anything or if something looks to high or low? Thanks :)

    Rent: 625
    Student Loan: 105
    Water: 66 (this will go down I think)
    Council Tax: 165 (this will come down as well)
    Gas: Unknown, haven't received a bill and i've been here 5 months!
    Electric: 25
    Contents Insurance: 10 (have to have it as part of my tenancy)
    Phone/mobile: 45
    TV Licence: 13
    Petrol: 150 (use my car for work everyday plus to visit my family)
    Car Insurance: 18
    Other travel: 6 (don't use car round town as its a nightmare so catch buses)
    Food & Housekeeping: 200
    Clothing: 20
    Haircut: 7
    Clothes: 20
    Opticians: 10
    Dentist: 20 (have been told i need a crown which supposedly will cost 250 but can't afford it at the moment)
    Prescription: 7
    Car tax/mot/service: 20
    Holiday: 20
    Emergency: 20

    Total Expenditure: 1572

    Income: 1743

    Difference: 171

    Expected IPA 171 * 60% = £103 (just guessing this!)

    Do you have breakdown cover for the car?
    Dry cleaning ?
    Are you a member of a professional body?
    Total Expenditure: 1572

    Income: 1743

    Difference: 171

    Expected IPA 171 * 60% = £103 (just guessing this!)would be nearer £85. 50% of excess.

    The council tax and water are high as have only been here 5 months and took me a few months to get all the bills (and single persons discount for council tax) set up, i'm a bit worried now as i'd assumed that I wasn't in arrears as it was all for the current year, would the OR look at these as though I was paying off certain "debts"?

    The council tax will be about £70 ish and the water probably around £25

    I'm not sure that i'll get a gas bill as it's only for the hob and have a feeling it might be paid as a service charge by the landlady, i'll check though.

    I do have breakdown cover so thats about a fiver a month, had forgotten that :)

    Just spotted the clothes as well .. doh!

    Oh yeah.. this is for a single male!

    Just to add, when I first decided to go bankrupt (under advice) i was budgeting about £300 to pay off debts, with the bankruptcy I was hoping for around £150, I know you can't give an accurate yes or no answer but in your judgement would you think that i'll be under this given my expenditure? (anything under even a fiver would be a bonus :) )

  • Your CT and water arrears can be included in BR.
    I don't think its a problem that you've been paying them, after all the alternative is prison for non payment of CT .:rolleyes: and being cut off for non payment of water.

    this friday is my last high payment for council tax so would prefer to get it out of the way, does it still count as arrears even though its for the current tax year?
