I was helped out by a family member whom paid some debts off on their Credit Card for me. I beleive this debt is now paid but am being told different. I have asked for proof of this money that is being disputed but have been informed that this not possible. I am also moving abroad in the next month but am being threathened with Small Claims Court, can this be done and will it follow me abroad??
Did the family member who helped you actually pay off all of the debt?
A lot of the debt collection companies threaten court action, but many do not take it. After all, it costs next to nothing to send out threatening letters but it does cost quite a bit to start proceedings.
If proceedings are commenced, I strongly recommend you to fill in the defence form that they send you disputing the whole of the claim. Obviously, if you are abroad, you will have to ask somebody to keep an eye on your mail for you. Otherwise, the claimant can get judgement by default.
Yes, the judgement can follow you abroad, in that many local courts will enforce UK judgements. In practice, I doubt that anybody will bother. Without any proof or evidence you can’t take any legal action against anyone. Do not dispense with cash without any written proof, as you can't take recourse to any legal action if such a thing were to happen to you.0

My advice if somebody asks you to lend them money is to give it to them as a gift. If it is more than you would be willing to give them, then it's too much to lend.No reliance should be placed on the above! Absolutely none, do you hear?0

I could kick myself, despite me saying "do not lend to friends as you wont see it again" i went and lent 2 friends when we went out for a meal the other week. Whats more annoying is 1 of them doesn't have a job yet he seems to come across money to buy petrol to get him to uni(he could get a job but is 1 of those defeatist types) and the other 1 has a job but always seems skint.
I us stop lending to people who dont have a means to pay me back.0 -

If all you lent them was the price of a meal, you have got off pretty lightly. Just forget about it. It's a charitable donation to the needy.No reliance should be placed on the above! Absolutely none, do you hear?0 -

Yes i got off lightly but i keep on doing it despite saying to myself i wont ever do it again.
Thats not the point though, its the principle, i dont mind lending money if i get it back say the next day, they aren't needy though, they both live at home and get fed by the parents.0 -

You're a nice, kind person, who helps others. That's really lovely. Don't lose that and become bitter. Just as long as the amounts involved are affordable, forget about it. Some of the people on this thread have loaned serious amounts of money that they can't really afford. Just make sure you don't do that.No reliance should be placed on the above!
