    Hi - I'm no expert, but if Moorcroft are acting on their behalf, then they should request it from their client. Unless, of course, they're returning the account to Argos?

    Thanks thats what i thought - so i am wondering wether i send another letter saying alonmg the lines of not acceptable and they are unable to enforce the debt or collect from me??

    I would write back to More clap and tell them that as they are acting on behalf of OC they should have a copy of the CCA . Enclose the payment , and deduct the days from when they received your first request. Then send off the second letter when time limit is passed .

    No problem - like I say, I'm not an expert and someone might be able to advise better, but I would write to them and remind them that it was they who wrote to you demanding payment (presumably stating they were acting on behalf of Argos). I would tell them that you will not be requesting the CCA from Argos and that the account still remains in dispute. If they no longer wish to act on Argos' behalf in this matter, then they must notify you of this in writing.

    Buy the way Stapeley - since you're here - can you advise if the 12+2+30 days are working days or calendar days (so is it a total of 44 claendar days, or working days)?

    Had the same responce re my OH,s aledged debt at the end of may this bit says thats a big ooops
    "175. Duty of persons deemed to be agents.
    Where under this Act a person is deemed to receive a notice or payment as agent of the creditor or owner under a regulated agreement, he shall be deemed to be under a contractual duty to the creditor or owner to transmit the notice, or remit the payment, to him forthwith."

    As far as im concerned im waiting for there next move as sending that letter is just fog as far as i can see so the clocks ticking still.

    incedently not heard a thing from Argos or Moorrcroft since that letter.
    Thats it, i am done, Blind-as-a-Bat has left the forum, for good this time, there is no way I can recover this account, as the password was random, and not recorded, and the email used no longer exits, nor can be recovered to recover the account, goodbye all …………. :(
