    hi guys lookin 4 some of ur advice...wrote 2 apex 4 cca for a monument account i have been payin them 4 nearly 2 years they were bcw before but i thought i wud request the cca 4 the account on the 13th may they cashed the £1 cheque but no cca so i have stopped payin them but got a letter from them looks like they have added 30 pounds on it as well saying my payments have now fallen into arrears and as such we now to talk to u as a matter of urgency etc

    wat should i do next

    Cahoot ignored our request for CCA for 6 months, then out of the blue it dropped through the letterbox.

    HI
    Just to update you,
    sent the 12+2 days letter to Mackenzie Hall and received a letter back yesterday. They must have been mightily p****d off cos the letter was just addressed to the house number and address!!!!
    Says they have contacted their client for the copy of the agreemenr and statement of account - said that in their first response letter too. Counting off the 30 days then will send off the last letter!!
    Mortgage free as at 1/9/13 :j
    To start work on the credit cards now!!

    no i never sent it recorded delivery but i would of thought that if they cashed the £1 cheque they wud have read the letter......should i send the 12+2+30 letter?

    If they've cashed your cheque, which accompanied your CCA request, then you have proof they received it. Probably best to send any further correspondence by recorded delivery though.

    (i have also posted my update on another thread i started). Moorcroft sent £1 chq back saying THEY dont have and also NEXT dont have cca. they still want me to ring them as they say it is their understanding i ordered and received goods so a default remains and i am to ring them with settlement proposal. Nobody is saying that the debt wasnt mine it was just the way that Moorcroft went about it without the proper document to enforce.

    Advice please.... I ordered and received goods via a friends catalogue company about 2 years ago. All payments were made through my friend. Friend now v ill and has started sending me the bills and I cannot afford to pay. The bills are under my name c/o a friend. £500 is still outstanding. £500 paid.

    I was wondering if contacted them to explain the situation is the right thing to do or to stall for time should i ask for cca. (I know they wont have one as i never returned a signed document or was directly involved in the placing order, payments etc). Not yet been sent to a DC agency but it will be.

    I did receive the goods and I know the debt is mine so feel bad about contacting them just to wriggle out of the debt but at the moment, am so strapped that it sounds appealing.

    Sorry, done a quick search of the boards but couldnt find any standard letters or anything. What would you guys advise?

    Sit back and relax (easier said than done) the onus is on them to do something not you. If they send you threats for not paying simply write back saying this account is in dispute, you have no rights to........under the CCAct 1974. Remember I am only saying this in reponse to your last post I am assuming that you have completed the other steps correctly and it is a loan or credit card.

    Bummer, got a copy of a signed CCA from Bank of Scotland Credit Card in my old married name (which I haven't used for over 6 years) and with my old address details (where I haven't lived for over 6 years). Guess I have to keep paying,:rotfl:
    LBM £18463.32 in debt 10th June 2008,
    £12470.99 in debt 10th June 2009.
