    I've had a letter from Apex today. I CCA'd them in March this year. They said they have requested the data from their clients (Cahoot and TSB) and have had no reply from them. They have closed both accounts held on their system and have returned them to their clients. :)

  • Afternoon peeps,

    I sent a CCa request to Cabot Financial regarding two accounts I have with them on the 19th April. They wrote back immediately saying my accounts on hold and I should have the requested info within the 12 days. The 12 days came and went and they wrote again saying the original lenders were having problems locating the docs but should be any day now.

    Fast forward 4 weeks or so and they have written again saying they apologise for the delay but the original lenders are still unable to locate the docs. The accounts are still on hold and Cabot will continue to request the info.

    What happens next?? its been almost 2 months since my original request.

    Hi
    OH received several phone calls from this company saying he owed them money. He denied owing them money. I got on here and copied and sent them the first letter which was signed for on 12/6. Told OH to ignore all phone calls from MH since letter was sent - there were 4. Letter received today from MH stating that account has been put on hold as they have asked for copy of agreement and statement of account. They also stated if that they do not receive the proof with in 28 days they will close the file and return the file to the client who will then decide what step to take.
    My question is - do I wait the 12+2 days and then send the second letter (30/6/08) or wait 12+2+30 or wait for them to get back in touch.:confused:
    OH very impressed with this site and happy for me to sit and read on a night time

    needtosave - after 56 days if the dispute is not settled then you can lagitamately complain to The FOS. After the 12wd you are intitled to stop paying ,it is up to you?

    Sunny Donny - Start counting the working days from the day after they signed for it

    It is important that after the 12wd+2 to start the companies official complaints proceedure, this will help the FOS if it is not resolved within 56 days. 56 days is quoted in the banking code and at the FSA.

    May 2008 = <5k of Debt (CCA route -48K, paid off 3K) DFD April 2010
    Nov 2008 Lloyds found CCA for 14K loan:mad: New DFD Jan 2016

    Thanks so much for your help - have put a big note on the calendar 12+ 2 days is 27th June!!!! Will be back then to let you know if I have or have not heard anything from them. OH under strict instructions not to talk to them if they ring.

    get in the habbit of saying thank you for your call please put all communication in writing, good bye. If they but, but , but you, then it's thank you good bye and put the phone down. Don't even answer their security questions!

    It us a while to get in the habbit now it 's second nature. It's wise to start a log it may come in handy later on

    Hi all,
    i know i have been away fro the forums for a while but i thought i would update you with the following:

    i had 2 debts with wescot one went to the courts and i got a CCJ. and 1 with 1st credit.

    ok to wescot:

    after 3 mths they finally turned up copies of a CCA so i guess i have to ay them, ok fine, however one f them is a ccj so i really do have to pay that but the other isnt , and they also sent me copies of my CC statements and boy there are over £900 other of charges and PPI charges on them, ok i know its longer than 6 years but i have written to HFC bank to claim these back.....what do you think? long shot or tough?

    i have also asked wescot to provide me with copies of the statements on the other account and i am going to do the same thing - never know huh?

    they still have not supplied me with more than that illegible copy of the credit card application form and the debt line says they are pushing their luck but i do need to see a solicitor and get their legal view, so please if anyone is out there that can help then please msg me and i can give u my number and we can talk, any help would be much appreciated.

    Sorry to here about the CCJ hope the judge set it at a reasonable payment. There is one positive, you are on that rate even if your income goes up, they have to go back to court to get more, on the other hand if your income goes down you can go to the court and ask for a reduction. Did you get the sum owed fixed?

    the ccj one was done about 4 years ago..... i just stopped it while i was waiting for the cca request
