    I've put this reply with the copy of the original letter I sent along with proof of postage. The letter I sent was the standard template off the Nat Debtline website and it is very clear what was requested. It is just them not admitting that they don't have a CCA for this account. If any legal action should start then I'm ready for defending myself in court.

    Well CCA request was signed for by Apex yesterday. Came home from work to 12 messages on answer machine from Apex (glad Im not paying their phone bill!)

    So guessing I count 12 days from yesterday right?

    Can I check what happens if they do send a copy of the CCA back? Really worried I will have made them mad by 'stalling' so to speak and I know they are going to demand full payment like they did before.

    I CCA'd Barclaycard/Mercers back in April. It was signed for on 23rd April. To date no CCA has arrived, no acknowledgement or anything. I'm just waiting for it to go past the extra 30 days and I will be writing to TS. Incidentally, during this time, they have constantly hassled me, lumped on extra charges and sent a doorstep collector and demanded the full amount and I'm sure they should be holding all action until they have supplied me with the CCA.

    I will be complaining to BC/Mercers also when the time is up. I wouldn't be doing this if they hadn't been such a pain in the bottom and refused to accept my offer of repayment.
    Debt 30k in 2008.:eek::o Cleared all my debt in 2013 and loving being debt free :)
    Mortgage free since 2014 :)

    Officially it 12 working days after the day of reciept, Then add a couple just incase they posted it on the last day.
    June 2005 = 48K of Debt:cry:
    Sept 2006 Started dmp = 56k of Debt (inc fees and charges) DFD April 2030:eek:
    May 2008 = <5k of Debt (CCA route -48K, paid off 3K) DFD April 2010
    Nov 2008 Lloyds found CCA for 14K loan:mad: New DFD Jan 2016

    Happy so far tomorrows another day:confused:

    Ditto Deep In Debt - I've had same problems with Barclaycard/ Mercers and then RMA and Moorcroft who they have passed the alleged debt on to - all any of them have produced over the past year are partially legible copies of application forms.

    Leixlip - at least they've produced something for you! They've totally ignored every request of mine and not sent me anything although I sent them Recorded Delivery and they were signed for. As I say, just waiting for the 12+2+30 to pass which is shortly, then I will be firing off letters.

    Today, almost at the end of the 12+2+30 day period (Tuesday), I finally get a response from Barclaycard after all the grief they've given me in the meantime. Anyway, it is an extremely poor copy (looks like a microfiche or screen shot) of my original application form from 2001 and a copy of current terms and conditions. Finally, they respond with what seems to be an unenforceable agreement. I am still paying them, but have to much to lose if it goes to court.

    Wouldn't be doing this if they hadn't been so nasty. They were the ones that suggested I went to CCCS - I did, and now BC refuse to agree to my DMP. What they have sent me is truly shocking - not even legible!

    I CCA'd Cahoot in 31st December and got nothing back from them. The have sent it to a DCA and I CCA'd them, now this morning after all this time an agreement has arrived. It is very difficult to read, there seems to be a line down the page so there are a couple of words on each line that cannot be read. Can I write back to them asking for a legible copy? The DCA have given me 14 days before they start chasing payment.

    You can request that any forms they send you are legible. The CC ACT also states this . Why not do a SAR if its a CC DEBT then request all the statements . If any are missing they would in my opinion be unable to take it to court .
