    I believe they will put a default on your credit file even if they can not provide a CCA. But for me that is not an issue , as I'm not planning to apply for any more credit . Anyone been taken to court yet ?

    I've been taken to court, sent in our defence, the court wrote back saying they would send it on to MBNA and if they didn't address the concerns within 28 days there would be a stay. The only thing MBNA sent to us was our current terms and we have heard nothing. The 28 days is up soon and I will write to the Court sending them what we received from MBNA. It will then be up to MBNA to re-instate the court stuff before the court can make a decision. In the meantime, we can't be chased for the debt. A result so far!

    Well done ! Many people are scared off by these court procedures , thats why so many CCJ judgements are made . Some people don,t even turn up in court , and thats what these DCA are banking on .

    Just to update
    I have had 2 replies out of 6 from my cca requests.
    The 1st was from Lowell saying they are trying to get the information from the OC so I dont know what happens next with that.
    2nd from wescot ...no letter just a cheque for £1 and a slip saying refund of £1 payment for agreement number blah blah.
    so what does that mean??

    the others havent replied so I will send the next letters at the end of the week
    I MAY HAVE NOTHING.....BUT ITS MY NOTHING

    You are part of the game now!

    All you have do is count the days 12 working days + 2 days postage and the 1 calander month from the end of the 12 working days. It is your choice if you send a letter after 12 wd+2d and after the 12 wd + 1 calander month (personally I have). It is not a prerequesit to charge the £1 some DCA's do some don't - but they still have to abide by the rules of the game, just start counting

    May 2008 = <5k of Debt (CCA route -48K, paid off 3K) DFD April 2010
    Nov 2008 Lloyds found CCA for 14K loan:mad: New DFD Jan 2016

    I received a letter today (at 12+2+68!) from Moorcroft saying "Thank you for your request for a signed copy of the relevant agreement under the Consumer Credit Act. I can now confirm that on this occasion we are unable to provide a copy of the signed credit agreement requested. We are now closing this account and returning it to our client"

    This is for a Cahoot credit card - I also CCA'd Cahoot and they have sent me a copy, it has all the relevant stuff on it, but they also sent a copy to Apex, when they should have sent it to Moorcroft. Apex have my Cahoot loan account but not my credit card account.

    Anyways, I will carry on paying what I can afford to Cahoot. I'm made up that Moorcroft are off my case :j

    If I where you i'd let others take a look at your CCA. Post it up on CAG or CCS to get their opinion.

    Ta Kel, I did put it up on CAG but no-one talked to me :( I think I remember you've seen it because you said about it giving you a sore neck!

    It does seem strange that moorecroft are returning it and the letter saying they cannot supply cca?
