    I requested my cca from (those lovely helpful people at) Marlin for my sainsbury visa and just rec. a reply.:eek:

    firstly the letter states pls find enclosed copy of your conditional sale agreement. (not sure what that is meant by that:confused: ) and that a copy of soa will be forwarded

    Looked at enclosed and it is a copy of my application form.
    Headed - card request form, filled in by myself, it also has a bit i filled in with a balance transfer request the bit about data protection and a sig by sainsbury at the bottom stating application accepted and agreement signed for on behalf of sainsbury.........thats about it

    Phoned Marlin (YES I KNOW NEVER PHONE - SORRY) they said that is the cca and to take it up with Sainsbury.

    i Have been doing the research and reading the links but its always nice to hear others opinions to see if you think that that is enforceable and to seek advice re next step

    Hi all

    We are currently with the CCCS and have recently sent the 12 day letter to the DCA (posted 12th March by recorded delivery).

    So far we have not heard a thing from the DCA. DH called CCCS last week and they have said that they will stop paying them as of now.

    However, do we still need to send the 30 day letter?

    Can another DCA still chase?

    Many thanks for any replies.

    What year did you take it out. Are there any prescribed terms - is there a copy of the terms and conditions. People need to look at it for you to bre sure

    It is your choice, I have, others have not. Have you sent a letter after 12 working days saying that they are in dispute, again some say it is esential others do not. But after the 12 working days (in theory) they can not move the debt but they will try. If they do you write to the new DCA and tell them it is in dispute and if they continue with their application for payment they are committing an offence especially if it is after the 1 calander month. But if they do continue don't worry it's harrasment and therefore you could get some compensation if you complain to the Financial Ombudsman Services.
    June 2005 = 48K of Debt:cry:
    Sept 2006 Started dmp = 56k of Debt (inc fees and charges) DFD April 2030:eek:
    May 2008 = <5k of Debt (CCA route -48K, paid off 3K) DFD April 2010
    Nov 2008 Lloyds found CCA for 14K loan:mad: New DFD Jan 2016

    Happy so far tomorrows another day:confused:

    i took the card out in 2000. there are no prescribed terms or copy of terms and conditions. i will scan it and see what you think. its just a front copy of my application form with no reverse

    What is clear now , is that the credit industry made a ALMIGHTY COCKUP afew years back with the issuing C/C and some loans , without the correct paperwork in place ! By some of the amazing responses it is also becoming clear the are panicking , are they snowed under as I predicted in my First thread ,lets all request our cca ?

    I sent a 30 day letter to International Collections, asking for them to remove the negative information on my credit file as they have failed to provided a CCA or any documentation relating to the account. They have sent me an bog standard letter today saying they are unable to trace any account with the details provided and they will not progress until I provide them a correct reference number or client details.

    I used the address and the reference that that was on my credit file so how can they claim that they have no reference when they put the information on my file?

    What shall I do next? Shall I send them copies of my file which show the details? This is a satisfied debt I am just trying to remove the default.

    Double check your copies to make sure you hav'nt writen it down incorrectly. Then a letter to them saying that you are confussed the references you have asked for in your letter of xxxxxx are in my letter of XXXXXX copy attached. If you have any faurther difficulties meeting your obligations please continue to correspond with me in writing.

    Short sweet and to the point.

    You need send International Collections nothing. If they fail to remove/correct any defaults, then you can report them to the Information Commissioner's Office.
    I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
    If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

    Rog by not challanging the letters intent i.e we have no knowledge you are giving them the oportunity later along the line to say - well we sent them a letter saying we cannot find the reference number it is not our fault?

    I wouldn't think so, kel - providing, of course, that Ikava double checks that the reference numbers tally.
    It is the duty of International Collections to ensure that any information that they publish in the public sector, about an individual, is fair and accountable.
    If Ikava wishes to write to IC, then, yes, I agree that any correspondence should be 'short, sharp (rather than sweet :rolleyes: ) and to the point' and a letter along the lines that you suggest would be fine - perhaps even enclosing a copy of the reference as it appears in the credit file.
    I, personally would state that a copy of all correspondence, including this letter, is now being sent to the Information Commissioner's Office.
    IC sound like a pretty unprofessional bunch - I have a feeling that I may have encountered this crowd over a 'BlackHorse' account. :confused:
