    Official Complaint – DCA NAME

    I have recently contacted the above company with regards to an account that I have been paying for come time. Recently it has come to light that I have had no evidence from the said company of the debt.

    I have requested the CCA, and followed the legal procedure. DCA NAME is now in default and is now breaking the law if they pursue this debt as they have failed to reply to my letters and failed to supply me with a true CCA, or anything at all.

    I am now reporting this company to your selves as they will now be committing an illegal offence by attempting to continue. I have suspended all payments to them while they supply proof in the form of the CCA in the allotted legal time frame.

    I would ask that you support this and contact DCA NAME to advise them of this complaint and ask that they adhere to my requested as stated in the letter dated XXXXX.

    I have enclosed copied of the letters sent to them for both separate accounts.

    I look forward to hearing from you in due course.

    Hello, Don't know if I am in the right place, I have posted this somewhere else on here, I wondered if anyone could help me please. I have today received from Barclaycard some documents and I don't really know what i'm looking for in terms of a true CCA. They are

    1. A signed copy Application Credit Card Agreement regulated by the Cunsumer Credit Act 1974.
    2. A copy of original Barclaycard Conditions regulated by the Consumer Credit Act 1974.
    3. A copy of the current Barclaycard Conditions regulated by the Consumer Credit Act 1974.

    None of which are signed by Barclaycard and the only time we signed was on the application.

    I would appreciate any help to find out if this is unenforceable or not.

    Today received a reply from a collection company, to my letter reminded them that I had told them the form I was sent in response to a CCA REQUEST was eligible. The letter says they have referred the complaint to the OC . They apologize for any delay . They go on to say " in the meantime if you have any questions please do not hesitate to contact me."

    Maybe they could answer , why they think I would be stupid enough to accept a blurred and eligible copy of a application form as an enforceable CCA ?

    Stapeley, The application dates from 26/11/2001, there is no signature in the box where it says "authorised barclaycard signatory", but this is the form that was filled in to apply for the card, it even has "priority application" on the top of the form, surely this is just the application form. It is the only thing we ever received and signed apart from the card.

    Can you scan it and the T&Cs in (blanking out personal details)?

    If you can, if you post it HERE then there are people who are accustomed to working out if these things are valid or not.;)

    EDIT: The lack of the creditor's signature does not prevent a court enforcing an agreement.
