Is there anything on the document other than your name/address/sig that identifies you to this account i.e ref Number, account number etc If not how do you know this is the correct cca?

If the form they sent complies with the required format and contains the prescribed terms as set out in the CC ACT , it could be enforceable by a court . It matters not that it was received late , that's a matter that is not dealt with by the courts . So you may now choose to question or dispute that the form sent is a true copy of a enforceable agreement .You need to do some case studies to check out the procedures used to counter any court claim if you think it will go that far . Example can be found on the CAG WEBSITE .

    hi all,

    me again :-)

well i have sent the 12+2+30 letters to wescot and not a sausage. after my last letter i sent a letter to the trading standards office and made a complaint against wescot.

Today i received a letter from the process manager:

"your letter has been forwarded to the process and compliance team who deal with the investigation of the matter you have raised. this will be allocated to a process and compliance co-ordinator who will contact you again in due course with either a full response or a further update of the investigation.

in the meantime, i would like to thank you for bringing this to our attention. it is important that we are made aware of instances where individuals feel we have fallen below the standards expected of us. we shall use our best efforts to resolve this matter from you quickly and to your satisfaction, and i enclose a copy of wescots complaints procedure which provides details of how we deal with complaints or concerns.

    yours sincerely

    process and compliance manager"

What do you think to that???

mo I cal see no interest rate only an apr of 3.9% also no credit limit, It is difficult to read what does it say above your signature box (agreement). Also does it tell you how to pay and how much ie min (£5 or 2% etc). Does it refer to terms and conditions, have you been sent them? On the second matter I would sit tight and see what happens.

as for the agreement yes all it says is 3.9% no T&C just that.
the bit above signature says " this is a credit agreement regulated by the consumer credit act 1974, sign it only if you want to be legally bound by its terms"

There's a number above my name and address - I've just logged in to internet banking and it's on my personal homepage as my customer id.

    Thanks for the suggestion though.

Mo my understanding is that because it is not signed by them then it is not a properly executed cca, meaning that it is only enforceable by a court (slight difference). Couple this with no T&C, no reference of how and what to pay and only an apr not an interest rate I would write to them saying that they have not supplied a properly executed cca. You then have to make a decision based on their reply, do you stay the course and take the risk of getting a ccj or do you bow out gracefully. A question though, in the top right hand corner is that a stamp with a signature and date in it?

Do you think they could argue that this is their signature
