I dont see why your DMP company have said that you cannot contact your creditors....are you with a fee charging company?(if so move asap to a fee one-fee charging companys cannot do any more than a free one)
I would still contact them with a CCA request letter....wouldnt hurt to do it

They don't charge us anything monthly. We paid them a fee at the beginning. The ironic thing is, they have only done the same as what the CAb did when we originally sought help!!!0

A DCA writes to me telling me "we are instructed by original creditor to collect the above debt"
I write back saying although a CCA was requested from the original creditor, and another DCA prior to this latest demand, nothing is forthcoming.
They respond by telling me I have to contact the OC with £10 for an SAR if I want to access information about this account.
I am considering three options:
1. Ignore the letter (its unlikely an enforceable, or indeed any, CCA exists)
2. Write back to the latest DCA with a CCA request
3. I thought that if they use the language "we are instructed to collect the above debt" then they took up the rights and responsibilities of that debt and so they should supply the CCA.
I may need some advice over option 3 as there are different forms of debt assignment.

If you have requested a CCA from a creditor/DCA and they have not supplied one then they are in default. Whilst it is in default they cannot pass that account onto another DCA. If this is the position you are in then you need to write the "Account in Dispute" letter. Found at:

Just thought I'd drop in with an update. You may remember that a while back I requested CCAs from 3 DCAs. Only one was able to supply a bona fide one, so the other two will be entering default tomorrow unless by some kind of a miracle I get something from them in the post today.
After tomorrow, what should I do? Offer a F&F to them or just sit quietly and wait to hear from them? Money is pretty tight at the moment so the payments I would ordinarily make to them would come in very handy, but I don't want to make things worse. Hi Cocker - I have no specific 'intelligence' regarding Equidebt, but, based on what I have been told, I would suggest a 'starting point' of around 20%, based on the fact that it is easier to 'increase' your offer rather than 'decrease' it.I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.

Hi. I have received a "true" copy of my CCA with MBNA but I believe it has been "doctored" to comply with the necessary prescribed terms. Has anybody had a similar experience and/or advise on how I might establish authenticity? Regards TUIB.0

Firstly send off the 12+2 days letter.
What to do after that is entirely up to you. If they have not produced a valid CCA they you are in control. They cannot ask you for money. You can either
1) Do nothing and not pay a penny - chances are it will get passed around DCA's and you will have to keep writing "account in dispute" letters.
2) Make a F&F offer for a small amount - like rog2 says "start low". This should be the final thing on the account it done and dusted.
3) Make an offer for monthly payment for an amount you can afford - will pay it off for many years to come.
Remeber you are in control now until they produce a CCA (chances are if they couldn't now they they won't but not 100% guarenteed).0 -

What makes you think it has been doctored? It's not been unknown for this to happen.0
