    Hi all,

I posted a few letters away to debtors requesting cca's and I received another two replies this afternoon......

    Letter 1

    Shop Direct Finance

Unfortunately we are unable to locate a copy of an executed agreement for your Very account, but for your information we enclose a copy of the current agreement with applies to this type of account.

According to our records the account was opened on xx/xx/1998. You agreed to make payments every 28 days.

The outstanding balance is currently £xxxx. Our records show that £xxxx in payments have been made in the last 12 months.

If a third party is acting for you please pass a copy of this letter to your representative.

So question is .....do i still sent Shop Direct next letter on 4th Aug?

and.... whats the tsb letter all about??

hi, i dont know about the tsb letter but i had same letter from shop direct and sent them the default letter, they looked into it. and wrote back saying they cant chase as they cannot find the agreement but reserve the right to claim the moeny if they subsequently find it.

personally, i reckon they are trying to buy themselves time... is it a card you have used recently??? if so, i wonder if they dont have enough information how they work out which account to charge it too

someone more knowledgeable than me will be along soon im sure. But i would say you give it the 12+2 days and send the default letter.

  • I have posted this in another thread then I found this thread
    at the end of July:

I have asked Moorcroft to send me a CCA as they send me a nasty letter saying that they may take me to court if I did not pay the debt in full.

At the mo I am still waiting for the CCA.

The account has only just passed over to Moorcroft.

Moorcroft have put my account on hold till they get the CCA from citi, to send to me.

moorcroft have sent me a letter to say that they have been in contact with citi and they (citi) have not recieved a request for a CCA from myself ( I didnt ask citi for a CCA) moorcroft have asked me to send a letter to citi to request a CCA from them and moorcroft have put my account on hold. I am confused as to why I should send citi a request as moorcroft have the account at the moment and are asking for money from me. I have send moorcroft the second letter so I will see what comes of that.

they'll be stalling for time... a classic tactic, if you look back earlier on in this thread you'll see similar stories and the same kind of tactics.

    Thanks pebbles :D

I thought they were maybe stalling, im not sure what they are going on about regarding section 78 etc, I sent them the normal cca request letter and sent them a cheque for £1 ....which of course i never received back even though it reads like they are wanting another £1 cheque.

do you think i should just send them the next stage of the letters which are due on Tuesday?

If you correctly sent the first letter and fee, then yes, just send them the 12+2 letter when the time is right. Remember, if they cashed the cheque, you have proof they received it!;)
