I havnt started a DMP yet but am going to contact payplan this week so I am still making full payments at the moment (not for much longer) - should I send the request letter to all my creditors now or do I have to wait until I have entered into a plan before I send them ??
thanks
Personally speaking, and thus my opinion only, I would CCA all the creditors first and wait until the results of that before speaking with Payplan. It will only be 12+2 days before you know where you stand with each creditor and having the ball in your court for some may help pay the others off faster.
e.g. if you had £100 per month spare and 4 creditors could not produce a CCA and 2 could then you could pay £1 to each of the 4 who could not and divide accordingly the remain £96 to the ones who could thus paying them off faster.
Of course you may wish to not pay any thing to the ones who could not produce a CCA but thats entirely your decision and what your current financial situation allows. But always remember a creditor may produce a valid CCA at anytime so dont take for granted that because they cant produce a CCA now they never will but at least it will give you some breathing space.
Hope this helps.0 -
Hi Bazza66
that does help a lot, Im going to get on it today !!! will wait and see what happens -
thanks:D0 -
What are the chances of a DCA taking it to court?
From what you have described, cocker, about the same as Nelson getting his eye back.
On the F&F front - I have it on good authority that many of the 'well known' dcas are 'willing to listen' to offers as low as 18%.
Tell us, or pm me if you don't want to name the dca and I will let you know if it is one that I have been told about.I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

Only print your name.
I wouldn't like to say why but I have heard on the grapevine  that some DCA's have been known to lift the signature onto CCA documents. Now they wouldn't do a thing like that would they?0 -

Once they 12+2 days is reached and they still have not produced a CCA then the creditor/DCA is in default. This means they cannot ask for payment nor can they add interest, enter anything on your credit file, or pass the debt onto anyone else, effectively the account is on hold until such time as a CCA is produced.
In a nutshell the ball is in your court and you pull the strings. If they continue to harass you then you have good cause to complain to the relevant authorities.
Generally they stop writing/calling to you but in some cases it starts again because they try it on again or they pass it onto another DCA (there is a letter for that).0 -

Hi, can I quickly ask for some advice please.
My dad sent in a cca request to barclaycard, who I must say promptly replied, with a statement of his account, that went into length about his payments made, spenditure etc,
It then went on to say that they would send him a copy of his cca seperately, my questions is , Is this normal for them to send it seperately from the rest of the information?
Secondly the credit card originally belonged to Morgan stanley and was taken over by Barclaycard some time afterwards. My dad has never signed any cca with the barclaycard when they took over morgan stanley, and is almost sure he didnt with morgan stanley, if he did it was a good 10yr ago.
My question anyway is IS it normal to send out the cca seperately, and secondly do you think they actually have it,
If anyone has any experience on this or any advice could you please let me know.
kind regards0
