  • Bazza66 - There are 3 inscriptions on the document they have sent me - my signature, a date (in my hand-writing), and another signature (presumably an MBNA employee). Even though there are boxes for these three inscriptions, only my signature is correctly placed. The date is scrawled across the terms and the other sig is next to my address. It's almost as if the inscriptions have been overlayed and copied from another document.

    It wouldn't surprise me to learn that a disreputable DCA would do something like this, but I was curious as to whether anybody had experienced similar with a lender like MBNA.

    Hi all, I wondered if you could cast your beady eyes over a letter Barclaycard have sent us today in response to our CCA request. I've uploaded it to photobucket. The letter basically says they are sending our CCA under separate cover and they sent T&Cs for 1998 and what the form would have looked like. If this is what they produce eventually I'm not sure whether it has all the "prescribed terms". Surely showing us what we would have signed isn't enough?

    Thanks in advance. I assume I now do nothing and wait for the 12+2 to be up. Then do nothing further until another 30 days then send off the letter to say "you haven't sent what we asked for................".

    Hi Rog2, grateful for your attention to this. The card was taken out in 1998, I think. I guess that is why they have sent 1998 T&C's?

    The 12 working day is up on 12th August. Will they be able to send a blank agreement which they used in 1998?

    Hi All

    I am looking into sending off CCA requests to around 8 creditors.

    I have spent most of today researching this process (well trying as keep getting conflicting info from various online sources?!?!).

    I would be grateful if anyone can clear a few queries up for me:o

    1. Is the date pre April 2007 or sometime in 2006?
    2. Does the debt have to be under £25,000 (per creditor)?
    3. Does the debt have to be over £2,500 (again per creditor)?

    Any help would be appreciated as I have letters drawn up but I just want to check who I can send them to ie: 3 of the agreements were taken out in Dec 2006 and 4 are under £2,500.

    I dont think there is any maximum or minimum debt level against a creditor (in fact the only one I know of is it has to be over £750 to file for bankcruptcy) which affects the request of a CCA. In fact I am pretty sure there isn't.

    The pre-April 2006 thing is on-line applications and not having to have a signature I believe. Someone will correct me on that.

    Any chance you could scan and upload? Sounds very dodgy to me but without actually seeing it will be difficult to make an opinion. Are all the prescribed terms there?
