    Hi everyone

    Would love some advice so I’ll recap where I am so far with Barclaycard.

    14th Feb CCA request sent – B/Card failed to comply – sent a photocopy of a leaflet that was missing key terms.

    Start getting letters/calls from Mercers. – I sent letter stating awaiting CCA from B/Card.

    25th Feb – B/Card send request for pmt letter.

    2nd March - sent SAR to Barclaycard, they rec’d it 6th. This times out on 12th April.

    4th March – another letter from Mercers thanking me for letter and asking for pmt.

    7th March – the following letters sent to Mercers – Doorstep letter, telephone harassment letter stating Formal Complaint and account in dispute letter.

    7th March – Formal Complaint, account in dispute letter sent to B/Card.

    2nd April – Letter from Mercers detailing immediate action require otherwise we will send round the boys!!

    8th April – received April statement requesting pmt.


    8th April – received SAR info and the following is missing from what I requested in my SAR request
    • Original signed agreement
    • Duplicate statements
    • Printouts of all account transactions
    • All external correspondence sent by B/Card
    • Returned pmt details
    • Late pmt fees
    • Breakdown of actual cost for each charge
    • T & C’s on which they rely upon to claim such charges
    • Tue copy of the T & C’s at time of account opening
    • Subsequent amendments to these T & C’s
    There is a fair amount of printouts but according to them I have only rec’d 2 £12 charges in the last 7 years…. There is however a default notice dated 01/02/07 and a 48 hr notice of their intention to refer to debt collector on 12/04/07 but it says this is from Mercers. No letter to say they have assigned the debt though.

    The external correspondence from them is numbered and they do not all run as should e.g. 103, 104, 106, 119, 120 so my guess is that lots have been removed for whatever reason.


    So, my questions:
    • What should I do regards missing data
    • What should I do regarding subsequent communications after I placed the account in dispute – this applies to Mercers and B/Card
    • Should I contact them to say stuff missing or should I just leave it as their time is nearly up to provide everything
    • What should be my next steps overall

    Thanks for the replies. It does say at the bottom "This is a Credit Agreement regulated by the Consumer Credit Act 1974". My copy is slightly larger, but still not very legible. Should I write to 1st Credit asking for a legible copy, but not confirming the signature?

    They have 40 days to comply, the 40 days has not expired yet ;) you must allow them the time-scale prior to moving onto the next level.

    Sorry, read it wrong. It says last fee applied £12 in Nov 06 the the 2nd £12 says fee removed and that is the same date. I was on a nil interest pmt plan with them at that point. There is no details at all about charges over the last 6 years and there should have been some, quite a few I would have thought.

    last fee applied £12 in Nov 06
    The reduced fees were introduced during 2006 ;) prior to this date, it was a free for all :rolleyes:
