Thanks Bazza, i'll amend & send it to them.
Ive offered all three f&f of about 35% i was willing to go to 50% but they messed me about too much so im now going this route.
If they cant produce a cca then i'll offer them 25%.0 -

I have asked this question before - If they cannot produce a CCA what should I offer in a F&F. The general consensus I got was that why bother offering them anything? But if you do then you have to send the F&F letter with careful wording. I think somewhere on this thread there may be a template (its a long thread so ou will have to do some searchs) for offering F&F.
My personal opinion if that if they cannot produce the correct paperwork then why pay them anything? Especially if they cannot provide a Letter of Assignment - if they cannot produce that then you could be paying anyone? I certainly wouldnt pay someone if they just said I owed them money. But thats my opinion - others may differ from that.0 -
Forgot to add - remember DCA's buy your debt for pennies in the pound! I have read that it can be as little as 2% of your debt!!!
So if you are offering a F&F remember that!0 -
Update. Halifax have closed their investigation and are passing it back to Blair Oliver Scott for debt collection. No CCA but they couldn't give a toss. Phone calls resuming in the near future I assume.Barclaycard 3800

Not really been following what you have been doing BH?
But that is par for the course for Halifax (HBOS). They seem to think regulations and Acts of Parliament are optional (when they are not in their interest anyway).
BOS are HBOS is disguise anyway, so they are still not prepared to sell it off then?
Have you anything to do a F&F?

I used the National Debtline template for the F&F, but was messed around by the dca companies.
Told them i wanted the offer in writing only ect, the phone calls continued so i wrote & stated that all correspondence to be in writing. They ignored this.
Thats why i requested a cca from all three.
The phone calls dont bother me, i find them laughable & always inform them that they maybe recorded for future use.
As to why im willing to pay if they dont have a cca, i want this out of the way & rebuild my credit rating.0 -
Hi sorry to butt in could someone help me please? I have sent the 1st CCA letter to Lowell finance who have the debt for a barclay card. The letter was received on the 18th of Feb and they replied on the 20th Feb. The letter says they are requesting a copy of the agreement from the original lender. However when I have gone onto my credit report on experian on the 28th Feb the Barclay entry is now deleted. Do they have to deleted it when u reuest a copy of a CCA? Also can anyone tell me if once the CCA is found will they put the entry back on the credit file.

They dont delete when you request a CCA but they should (and thats a complete different ball game as to whether they do or not) remove it from your C/F if they have no CCA. Its dropped off either because more than 6 years have lapsed or Lowell-Life have removed it.
As for the letter from Lowell-Life its a standard letter - I got the same and after I sent the 12+2 letter I got the "we have 12+30 days to look for it" (they dont) and then eventually "we could not retrieve from archive" letter. Oh and inbetween you will get the amazing 60% off to settle the debt letter - which is basically them admited they have not got the CCA.
As for entry going back on C/F if they produce the CCA - I am guessing they can but not 100% sure on that one.0 -

I cant image that B/C would remove the entry because they have passed the debt on. It could well be that Lowell have removed it. Mine disappeared off my file but it was around 6 year mark as well so dont know which way it was.
Maybe Lowell are behaving and removing entries from C/F if they have no CCA? Anyone else had experience of this?0
