  • hi everyone - first time poster - i have a cc with Bank of Scotland 10k debt - if i ask to reclaim my cc charges is there any evidence they close the account - i can't afford to pay back the 10k as i have adverse credit and couldn't come up with that amount - so what would happen????

    any advice would be most welcme

    cap quest good or bad news. following my request for a cca today i received a letter back very quickly saying thay are putting my account on hold for 28 days while thay obtain the information required.
    is this good or bad ?

    Hi,
    I have had a letter replying to my CCA request that I sent to Apex. They have returned my cheque and letter and told me I need to contact Natwest in order to get the CCA. So do I now need to restart the clock and send it to Natwest as well?

    Also, Barclaycard sent me a leaflet with the terms and conditions from when I opened my account (Dec 2000 apparently) - is that the credit agreement? It's fairly smudged and I had to really concentrate to read it!!!!!

    Oh and I have one more question - I just checked my credit file on Experian and Equifax, and none of my Natwest debts (3 current accounts and a loan!!!) appear there. Is there any reason for that does anyone know?

    Okay BH we have had our differances in the past ! But now you see what some people are up against . If these companies had acted fairly in the past i.e . accepted reduced payment, stopped interest etc , many people who have now resorted in going the CCA route would be paying what they could afford . Which is better than nothing . WHY do they not offer a FF instead of sell off to a DCA at 10p in the £ .
    So anyway finally BH welcome aboard the good ship " UPYOURS"

    ANY company acting on behalf of OC have a duty to comply with your request . Write and point that out to them . And just sending copy of terms and conditions is not COMPLIANCE with a CCA REQUEST .

    With regards to Credit Referance Agencies.

    The same debt cannot appear twice, If it is simply passed to a DCA to collect then who ever owns the debt still records it. But if the Debt is sold then the original company that owns the debt has to remove it before the new owner can record it with the agencies.

    This bit may help some were the debt has been sold on:

    If a company has writen off the debt and then at a later date sells the debt to a DCA and the DCA attempts to collect. you can claim 'Estople' That is you can claim that the original write off stands therefore there is nothing to collect! Estople can be used were a change of mind is detrementle to yourself, you must have the evidance to back it up.

    May 2008 = <5k of Debt (CCA route -48K, paid off 3K) DFD April 2010
    Nov 2008 Lloyds found CCA for 14K loan:mad: New DFD Jan 2016

    Happy so far tomorrows another day:confused:

    Thanks, will write to Apex today then and tell them that, and will also reply to Barclaycard as well. I think it is probably the leaflet they send you when they send you the credit card to be honest, doesn't have any info about charges in it though lol and is definitely a seperate leaflet, entitled Terms and Conditions. Alhtough it says on it "this is your copy of our agreement"!!

    Hi Kel,
    The debts have not been written off, and I haven't had a letter from Natwest to say they have been sold, in fact the joint account we had my husband is still paying Natwest direct, so I think that it i possible that Apex are only acting as agents for Natwest. At any rate, Apex have been in contact with me for 6 or 9 months, so you woul dthink that the credit file would have been updated by now?
    Weird, isn't it!!! :)
