    Let them 'forge away' baz. As you quite rightly point out, they are already in default, so whatever 'document' they might come up with would need the approval of the court before they can 'enforce' it.

    I don't know why they waste their money on postage. :confused:

  • I need some help for my father regarding reliable collections (JD Williams). I advised him to get a cca and soa for the account which has been supplied (surprisingly quickly). The cca has been filled in by the JD Williams representative as my fathers details match their signature and my father hasn't signed anything on this form (I know there doesn't have to be a signature).

    The cca (in my impression) is a post 2004 one in that it mentions a late payment charge of £12.00 and all the new required terms are there. Until 2005 the late payment charges were much higher which is why I believe this is a new cca (although there has been one or two higher charges since 2005, there appears to be no consistency) The account was actually opened in 2002 so as far as im aware this cca isn't valid (primarily because I believe they signed it themselves last week) as the terms weren't in force at the time of the account being open - can someone clarify? Also, where does he stand if he's had admin charges higher than the stated £12?

    Reliable collections are an absolute nightmare, they're now sending letters saying 'we know you definitely live at that address' of course he does, he's been sending them letters from that address for the past year or more! They also made contact by phone and by letter after the cca request was sent (which I thought was illegal).

    Also is there a link about the 2004 changes so we can stick a paragraph in about it? Im also in need of an unenforcable cca letter for myself but can't seem to find a template anywhere.

    Hi,

    This letter is stardard practice from 1st Credit. Every time I send a letter to them, they always reply with this about a week later. I then receive a "proper" reply to my letters a couple of weeks after that.

    Thats what I thought. They never sent me one for my initial CCA request though. Ah well - I'll look forward to their letter in a few weeks. I have even spotted something else. The Barclaycard Account number they quote doesnt match at all and that there is a credit reference in that account number. Ummm...

    received the original cca request.

    If the royalmail (or postoffice) says it has been delivered then I would think that is enough proof. Sometimes they have so many "signed for" letters they just sign another doc to say they have recieved the batch. This is probably what has happened in your case. I have had one go astray as well.

    So if the post office says it was delivered on xx/yy/zz and the 12+2 days is up then send the 12+2 letter. I personally would leave it as "you signed for" even though you dont have a actual signature so you do not need to send the CCA request again.

    After reading through some recent posts, i've decided to send 1st Credit a SAR request along with my reply to their previous attempt to supply CCA as they cant get out of supplying the actual agreement with a SAR request.

    Is there a template letter for this or can I just request it in the main text of my letter and enclose the £10 fee?

    received another dafault letter from natwest cc today, they are now saying that if i don not pay the amount outstanding within 17 days that i will no longer be covered by my ppi... and also saying that they will send the default details to credit ref agencies... and poss cancel the agreeement and activate the right to off-set from any funds held anywhere else, i dont actually have any money anywhere apart from my DH's wage paid into our halifax account, the only other money i have is in barclays.. im pretty sure they cant touch it there.

    what i find annoying is that i actually sent them a default notice on the 16th, they replied with this on the 24th.... where do i stand with that? they have not produced a valid cca agreement

  • Also, forgot to mention. As 1st Credit have purchased this debt from Goldfish, are they now responsible for any PPI reclaim that I may make, and any subsequent refund of premium, or would that still be the responsibility of Goldfish as they are the original creditor?

    Hi,

    As far as I am aware, if they are still in dispute of the CCA request, they cannot default the account or inform any of the credit reference agencies about the account.

    This is most probably a scare tactic. Politely inform them that if they do any of the above, then you will report them for breeches of the regulations.
