  • i asked a dca for my CCA, its gone past the 12+2 stage, so i wrote that letter they have replied saying they are still waiting for it from the OC, they go on to say " although we are unable to supply a copy at this time we will continue to tell the credit reference agencies of the acoount status"
    Can they do this? i thought they could'nt

    You would need to upload the images to an image sharing site and then post here.

    Make sure you blank out anything that is personally identifying. Don't forget that can include bar codes and reference numbers as well as the normal personal info.

    I am sure that if they supply it anytime after you request it even though it is out of the 12+2 & then the + 30 days it still then applies!

    Yep. The CCA74 only prohibits enforcement after the 12 days while the creditor is still in default of the request. Once they comply at any time they are able to enforce the agreement again.

    It would be worth posting them as there are problems with some GE money CCA,s because they seem to forget there are terms and conditions on the back, which must be supplied before they have complied with your CCA request, and some of the older ones dont quote the APR on the front, so without the rest they are unenforceable;)

    this is interesting for me, i have only have had the front copy of the cca on a debenhams acc, now a dca has, now after visiting ts, they advised i should get the back too, so am awaiting on a responce from dca, of course all their letters insist its a valid agreement! even though it says its an application, but they do so insist its a credit agreement, hmmme lets see what reply i get back. ta very much, i thought i was going mad !:rotfl:

    Been reading this thread for the last couple of days.

    I am looking at my agreement for a loan that I took out in 2005. It shows the APR but not the interest rate. Does this make it unenforcable?

    Hi,

    I have just received a photocopy of my CCA. I am currently checking it is a copy which meets all the requirements, while everything looks like it is in my hand writing I have noticed the date which I signed for this credit card I would have been 17. As I have mentioned it all looks like my hand writing, but to my knowledge you have to be 18 to get a credit card? To be honest I do not remember when I got this credit card out (wish I never did). Would pointing out I was only 17 at the time of getting the credit card make my debt unenforceable?
