but am i right in thinking if i never signed a credit agreement, basically there isnt one?? and they cant register a default on something which does not exist?? im confused, i def thought i would have to sign an agreement for it to be enforcable?

You would for it to be enforceable in court (pre 2007), and you would to have a default issued, you cant default on an agreemant if that agreement doesnt exist as you say, but the creditors think differantly, they try to claim by placeing an order you entered a contract for example, problem with that is they cant prove that claim either, but wont be convinced of that fact.

    Received 2 CCA'S today :-

First one from Robinson way on behalf of G.E Money For £1850.93 dating back to 11/8/1998 and asking for full payment within 10 days.

The second is from G.E Money for an olsd principles card account dating back to 28/07/1992 with a balance of £1681.28 and asking for full payment within 25 days.

The reason we have applied for these CCA's wa sin the hope that some of the old debts that we have been paying for years through payplan could not come up trumps but these 2 have.

We normally pay payplan £131.00 a month for all the creditors but our Mortgage is increasing from £881.00 a month to £1070.00 from Nov 08.

Do you think its worth asking them if due to financial hardship & that we have been trying to pay these for years that they might right them off ?

A long shot I know but do you know if anyone has managed this ?

I will keep you all updated on anything else regarding the other CCA requests that we have outstanding.

    Thanks,

    Simon

All you can do is contact Payplan , let them know that you have to reduce payments . If you were taken to court , it can be shown that you have been paying through Payplan and a Judge will not be best please they took it to court . Are you sure the documents are in order ? Have you stopped paying the ones that failed to suppy a CCA ?

They are just docs to me but have our signatures on them .

I HAVE SCANNED THEM NOW :-)

I will post them if you want!

Should i omit our signatures off them or anything else?

    Thanks,

It would be worth posting them as there are problems with some GE money CCA,s because they seem to forget there are terms and conditions on the back, which must be supplied before they have complied with your CCA request, and some of the older ones dont quote the APR on the front, so without the rest they are unenforceable;)

Sorry if this has been asked elsewhere on this post, but a DCA has finally sent through a copy of one of my credit agreements, three months after I initially requested it.

Should I ignore this as it is so late?

    Thanks
