  • i sent a sar to JD Williams for two accounts (fashion world & Value cat) they sent me back a request form to fill in, i did so and in the part where it said what personal data i am seeking i wrote all admin charges and copys of cca.
    I have recived the list of charges and all info from their computer but no cca.
    What i want to know do they have to surply the cca under the sar (Data Protection act) or does it come under the other one where you pay the £1.
    I have paid the £10 for all this data.
    Studio, MBNA - Paid out
    Bank of Scotland, Argos- Offers received Court Letters Sent
    Fashion World, Value Cat - 2nd Letter Sent
    PPI - HFC - Letter sent
    HFC PPI, Capital One - With FOS

    There should have been no need for you to complete a form, but as you did and requested copies of the CCA, they should have been provided as part of the SAR. It seems the info they have supplied you is incomplete. You don't need to pay for the CCA as you have already paid for it as part of the SAR.

    Contact them and inform them that the subject access request is incomplete and you require all the documents specified.

    Hi all. I have been following this thread and the valuable advice contained!

    I have a quick question. I started the CCA process with capquest who are collecting a debt on behalf of amex. The 12+2+30 is up on 9th October. Capquest did send a copy of the original application form but this didn't contain any info i.e credit limit, interest rate etc. it was just the original form. I ignored this. On Friday I had a letter from HL Legal who said they were acting on behalf of capquest. It looks like a standard letter and they are saying that they now want the entire debt paid in full (I am in breach of the original arrangement etc.etc) and that if I don't pay by 3rd October "the escalation in the collection process may involve you paying costs" and then "in the event that proceedings are issued and judgement obtained it will make it difficult for you to obtain credit."

    Am I right to ignore this letter and hit them with the 12+2+30 lette on the 9th or should I write to them now?

    Any advice would be gratefully received!

    H L LEGAL are clap quests in house " solicitors" . I would send the letter now . I have to the same thing happening . I have just repeated that I do not believe that what has been sent does not comply to the CC ACT. They have said i have six months to complain to the B O S.

    If you look at post 1069, there is a link to some templates. Post 8 deals with the debt being passed to another company while it is defaulted/in dispute.

    You may need to edit the 12+2+30 day letter as since May (i believe), it is no longer a criminal offence after 30 days if the default is not resolved.

    Not really spent much time looking at this new development, but hopefully others will be able to comment and hopefully there is already an alternative template letter out there.

    after swatting up quite a bit for the past month ive kinda got the nack now hehe but one thing though, i know ive read somewhere along the weeks on the net googling cca's that if you sent a postal order for a quid, and the company doesnt send the cca you have paid for but uses it for something else like put it towards the balance they are pursuing you for then it can be classed on the lines as some sort of theft, or misuse of something or other, i cant remember the words and have looked everywhere for the official wording cos Aktiv kapital are robbing B****s haha
    they kept my quid << ok not the crime of the century but this kept me awake last night lol mulling over whether they sent the postal order back or not and i know they didnt now
    they still havent produced and they never used it to pay towards the alleged debt so what can i accuse them of now cos these people have been the worse debt collectors so far to deal with and get anything from. Im at a stalemate with them at the mo, having reported them to the CSA and currently compiling another to the OFT ( I am on the ball )
    any suggestions guys were to look for this please. i know it does exist i remember reading the thing i just wish id stuck it in the favs.

    That's exactly what 1st Credit have done with my two accounts.

    oh yeh some good news today, Argos additions were unable to produce cca and have wrote to me saying they will not be pursuing the debt for £481 but since it remains unsatisfied then it will be apart of my credit ref file for next 6 years. They do give in quickly additions cos thats the 2nd one wrote off in a matter of weeks as my partner requested one also for the sum of £812. so people it pays to know a little bit about your rights after all hehe
    I will now be writing to them that the fact they havent a valid cca they cant put a default on my file cos allegedly the debt doesnt exist etc
    RIP Additions file closed .......

    GeorgeUK posted a letter to send the other day regarding the use of postal orders against the debt balance. I e-mailed it to 1st credit for each of my accounts.
