response from bank not right?

i sent a cca to my bank for information about my bank loan as i feel i was a victim of misselling due to the fact i couldnt really afford it and they let me go way over my overdraft and then sold me a loan i couldnt sustain - i have thread on here explaining so will try find and link them...

anyway i enclosed £10 postal order for full information they hold on me...

this morning i received the results after weeks of waiting...

but

they have only included details of the final loan and not the very beginning of when this started - i asked for full details as the loan im paying now is a refinance of the original one as they terms were too steep so they refinanced to make it easier for me, thus, incurring loads more interest for themselves?

so

do i now have to ask again with another £10 or should i have had all information?

any help would be appreciated...thanks

    £10 would not be for a cca, but a subject access request.

    It depends on what you asked for really. If you asked for details of a particular account and this is what you received, then that may be all the information there was for that account number. The overdraft may have been a different account number which is why you didn't receive the details.

    yes it was sar sorry lol....i defo asked for information about any loans on my account so it shouldve included the both but it hasnt done....i have the information on hand for the overdrafts because i still have access to my account online - im just printing all my statements off (take forever) before they shut the account down as ive already switched to another.....

    Each loan will have a seperate account number. In the SAR, did you specify an account number or did you just request a copy of all information the bank holds on you?

    i used the sar request form on here i think - i will look later for my copy in my folder and see what exactly i put.....im sure i asked for everything though

    just to recap on this - i have found my letter and i asked for information held on me regarding the 2 loans (the first and the refinance) and also to see an income/expense form used in calculating my right to the loan (cant remember now id worded that lol)....

    the only thing that has come in info on the refinance loan so i will have to rewrite to them....

    any help with the new letter would be appreciated lol thanks so much

    im wondering too - i have missed 3 payments now on this loan while im sorting it but the bank havent even wrote or phoned me regarding it?

    WHAT CAN I DO IF THE DATA CONTROLLER DOES NOT COMPLY WITH MY SUBJECT ACCESS REQUEST?

    If the data controller fails to respond to your request within 40 days, or fails to respond to your satisfaction, and you have sent all the information required to the data controller to enable him to deal with your request, including the fee, you should send the data controller a reminder by recorded
    delivery, keeping a copy of your letter.

    If you still do not receive a reply fairly quickly or if you think that the information you receive is wrong or incomplete you may:

    • ask the Commissioner to carry out an assessment as to whether it is likely or unlikely that the data controller is processing your personal data in compliance with the terms of the Act;

    • pursue the matter yourself through the court. For information as to how to do this please refer to the leaflet called “Taking a case to court”.
