  • Yes I did have the goods, but am in a bit of a personal mess and have looked for advice on this forum. Next did not inform me that they were passing this onto Moorcroft I just got letters from them asking me to pay up. I opened the account online about 2.5 years ago. I thought if they did not have a cca then you can send the 30 day letter after the 12 day letter time limit is up? I read so many similar situations to mine on the forum, I need advice please.
  • Still waiting for a judgement from the FOS in respect of Sainsburys non-compliance over the CCA and also miss-sale of PPI matters. Apparently they have the info they require and it's about to be passed to an Adjudicator. Fingers crossed it's resolved before Xmas!
    Almost debt-free, but certainly even with the Banks!

    I am in a bit of a quandry at the moment, I have trawled back through the posts on this thread and to be honest it is all going around in my head that I can't make sense of it at the moment, so I am appealing for someone to point me in the right direction of what I do next..

    I sent off for a CCA request from Westcot on 9th October and today received a letter from Westcot stating that they do not have the CCA and therefore have passed to the OC, who is Studio cards, and that I would have to contact them. Plus there was no sign of my £1.00 postal order which I thought might have been there as they couldn't find the original CCA.

    What do I do now? Do I sent a CCA request off to Studio cards now, do I wait 12+2 days or do I do nothing and see what happens? I'm confused..

    Westcott should have access to what you need but if they have not then it will do you no harm and only cost you a pound postal order and the cost of the recorded delivery letter to send to OC wont do any harm and see what they come back with.

    I know the ACT was changed to allow for on line accounts , so depends on your date .
  • Well, sent my CCA request letter to HFO 15/09/08 (recorded delivery with £1 postal order). Have yet to hear anything. The time limit for them to reply has, obviously, passed by a fair margin now.

    What should I do? Is nice that they are not bothering me anymore, but problem is that I am not certain of exactly WHY they are not bothering me?!

    I would send the 12+2 days letter - you should get a response from that one!

    And still fighting the bar-stewards! They have finally acknowledged my formal complaint (following on from the 12+2+30 letter) - lets see where that one leads. They have yet to acknowledge my "Prove it" formal complaint which they failed to prove last time on another.

    Thanks for the advice, although my understand was that the 12+2 letter was to be used if the company in question was still sending collection letters?

    No its to inform them (they already know anyway) that they have defaulted and can no longer chase you for money until they come up with a valid CCA. Always best to have a paper trail just in case.

    Remeber do NOT sign letter and send Recorded.


    I'm not so sure about the sending the +30 days one anymore. Anyone know if its still worth it?

    Stupid quesiton though - the part of the letter which states "If the request is not satisfied after a further calendar month, your company commits an offence. Therefore on ********** 2007 this time limit will have expired" -

    Is the date to be taken from when the CCA letter was sent or from the date that they defaulted?
