    you should be served with a notice of assignment if a company buys the debt, until that is served they cant collect, BUT the trick is what is classed as served.

    If you have moved in the last few years it may have been [strike]purposly[/strike] accidently sent there. Or they will claim it has been sent, whether it has is anyones guess

    Just refuse to talk to them until you have a copy, thats assuming its not subject to a default CCA from the OC, if so they cant assign it to anyone without breaching the CCA Act
    HI Thanks for all replies ,but I do know about ASSIGNMENTS etc . Question was do carbot buy bad debts from hbos or act as agents ?

    Yep. Working days.

    The are in default of the request after the 12 + 2 actually. ;)

    While the default continues they are not entitled to enforce the agreement.

    The offense committed after the additional calender month has now been repealed I believe. But it was a technicality that was never applied or enforced really.

    I have just looked at their website , seems they do purchase accounts . That's good news, because I previously requested a CCA from another DCA who returned account to OC . This means that the OC have broken the conditions laid out in the CC ACT, by continuing to pursue the alledged debt and selling the account to a third party .Seems this DCA only have a phone number . So I just wait for a letter from them , then hit them with the fact of no CCA .

    Or did the DCA sell the debt to another DCA and didnt actually pass it back to the OC in the first place? Not that I would suggest a DCA would do such a thing? :whistle:

    Also the possibility of breaking the Data Protection Act from the OC/DCA?

    Get the feeling the next time they ring you will be asking them to hold while you get on with mowing the lawn?

    Had a least 60 calls to my mobile number ,mostly I answer, then ring off . Sometimes it just goes to answer phone, I MUST ring a miss jones to resolve a financial matter.

    I have now wrote to them , not included my address , informing them of the CCA request default . Told them they can ring on number they have to inform me they are discontinuing .

    Would it not have been better to include your address and get it in writing? If the CCA is still in default then you have nothing to worry about them having your address -they cant do anything?

    And even if you get some letters - look at the positive - it keeps your postman in a job! :D

    If they have not been given a correct address that's there problem. I am pretty sure there is no CCA available ,but just in case one may have been sent to a old address , the more links in the chain the greater chance of a break.
  • Hi does anyone know where I can find the template letter for the letter you send after the 12 + 2 working days for a cca request. I sent my letter to Moorcroft on 6th October and they responded on 8th October saying that they or Next did not hold a copy of signed credit agreement and returned my £1 postal order. I need to send them the default letter in the next couple of days and I cannot find a template for it anywhere. Please can anyone help.
