My understanding is that it is statute barred if you have not acknowledged the debt by either making a payment or by writing for 6 years. I'm sure someone will be along to confirm that.
Is it a valid CCA? It needs to contain certain terms and be signed. It also needs to be clear enough to read! I will try and find the terms and post back.0 -

I have got alot of advice from this forum and saved myself having to pay out £8K to lowell life (and still in a fight with them to reclaim some money and get defaults removed but thats another story and thread). So its nice to help someone else.

Not so confident about sending that letter now - the application form copy that I was sent does have a very small section printed on it entitled 'Credit agreement regulated by the Consumer Credit Act 1974'. Although it's completely unreadable, as is much of everything on the copy application.No problem - hope it works out for you.
