  • Ouch - HFO acutally supplied me with a copy of the agreement.

    Although it is dated October 2002 - doesn't that mean that it should be statute barred (due to it's age)?
    Any advice anyone? Please?

    Although it is dated October 2002 - doesn't that mean that it should be statute barred (due to it's age)?

    My understanding is that it is statute barred if you have not acknowledged the debt by either making a payment or by writing for 6 years. I'm sure someone will be along to confirm that.

    Is it a valid CCA? It needs to contain certain terms and be signed. It also needs to be clear enough to read! I will try and find the terms and post back.

    Is a copy of the application, signed by myself. Not very clear though.

    Don't see a way out of this though as no idea when last made a payment against the account.

    A copy of the application is not a CCA - see previous post for terms.

    Its not a avenue I have had to use but have a look at this - may well help you but I would get other opinions before doing anything.

    Thanks again - will take a copy of the letter. Seems worth using, although as you said, other opinions would be welcome.

    No problem - hope it works out for you.

    I have got alot of advice from this forum and saved myself having to pay out £8K to lowell life (and still in a fight with them to reclaim some money and get defaults removed but thats another story and thread). So its nice to help someone else.

    Not so confident about sending that letter now - the application form copy that I was sent does have a very small section printed on it entitled 'Credit agreement regulated by the Consumer Credit Act 1974'. Although it's completely unreadable, as is much of everything on the copy application.

    And still wonder if would be better to point out the age of the debt?
