help me dont know what to do

  • i did tell them at the begning of the year wheni found out.i got 1 letter from the collage for a progress evening did not get any letters from them saying he was not attending and no i dont have a proplem with facts just buting them across

    The best thing you could do is go to CAB with this.

    Re Housing Benefit - they would have been no non dependant deduction while he was at college as a full time student and there would be a deduction of £2.30 per week for any of the time he was over 18 and not in college (assuming he has little or no income). See Government website.

    Re Council Tax Benefit - as above and also £2.30 deduction.

    The thing you have to establish is a leaving date. Ring the college and ask them if he won't sort it out for you. Ask to speak to whoever was teaching him and explain the situation and say that you need a leaving date.. You will be asked this by benefits anyway so you have to find out. That is the most important thing you could do today in order to get help to sort it out.

    The other important date is when he left home. Make sure all the benefits are aware of this and that they know that you want to carry on with your claim.

  • cb sent me a letter saying from the 30.11.06 i think this was the last time he went.he was 18 in aug

    Do you mean Child Benefit? They only know a date that they have been told - it's up to you to get real dates by contacting the college, they will have to note down somewhere what his leaving date was.

  • i told child benefits hethe day he left home thaysent me a letter asking were he was liveing was he still at collage i told them i did not know any of these things then i got a bill of them saying it was from november 06 thay must of rang the collage

    Child Benefit - You must have informed them that he was in full time education up until the end of the last academic year and still and continued to receive it. However when you informed them that you didn't know if he was still at college then they have stopped it from the last date you told them he was at college. You would have had to inform them to keep receiving it. See HMRC website. Does that sound right? However they have got the date it's not from anyone else except you. This is why you need to ask the college what the leaving date is so that you receive the correct amount. This will also impact on your Housing Benefit & C Tax Ben.

    1) So what date did the college say he left.

    2) What date did he move from your house?

    You have clearly stated that you were getting letters to go and see them about his progress. Then you backtracked and said it was one letter!

    I think you need to get your facts straight and get to the CAB asap.

    If you are going to argue you could not have been reasonably expected to know he was not attending then I imagine they may want to check with the college so there is little point in hiding the truth.

    You really are best getting proper advice and that means facing up to the facts. No one here can offer any advice if you change your mind every post!

    Sorry to be blunt but you are going to end up with some very big bills and you need all the help you can get.

    Btw, they will take the overpayment from you, not your landlord.
  • thay went back to collage in sept 07 i got 1 letter in dec 07 has for o6 to 07 i was never awere of any problems this has only come about this year yes i did tell them he was in collage he did go and signed up for it and got the paper work i need to clam my benefits he just never went and no i did not know any think about it i even went and spent money on bits for collage what he said he needed.like ihave said befor i will pay any monies back just dont want to lose my house it is a houseing !!! will houseing benefits take it back off them
  • Have you actually spoken to the college yet? The most important thing to do is to get a statement showing his attendance. Once you are sure of the facts you need to get urgent advice from CAB. Hopefully they can help you to arrange a repayment plan.
