    What is staring people in the face is the fact you took 16k and didnt tell the benefits people about it.

    I'm not having a go in the slightest, probably didnt even think to, but you should have, it's fraud and illegal not to inform them of any change of circumstances.

    I think thats where this all stems from, you didn't tell them, but continued to take the benefits money. What you did with the 16k is neither here nor there AT THIS STAGE, it may be for an appeal.

    OK, think I understand.

    Your husband's debts to your family would have, unfortunately, been included in his bankruptcy. Therefore, in law, the debt was cleared and you didn't owe them anything. If you chose to pay them from sale of your property that was your choice but housing benefit will deem you to have deprived yourself of that capital, and you would have been assessed as to still have it, for HB calculations.

    How much did you clear from sale of the properties?

    Again, get yourself down to CAB and ask their advice.

    The OP has not committed FRAUD which is a criminal offence and KNOWINGLY done. Please read Gloucester.gov website. Fraud has INTENT. The OP was "ignorant" but did not deliberately try to obtain benefits. People are using the word fraud far too much and I'm sure genuine claimants are put off by this.
    What Is Benefit Fraud?

    Benefit fraud is a criminal offence that occurs when somebody knowingly or dishonestly gets more benefit than they are entitled to.

  • hi fran thanks for that. i never at no time set out to fraud income support or any one i just wanted to get things straight,at least that was one problem out of the way (so i thought) since my husband has death which was the worse time of mine and the childrens lives i have not been able to think straight, most days i didn't even want to get out of bed but when you have children you have to, my children deverstated.

    I agree with Fran,and as I said in a prior post I was a fraud officer for some years,to have committed fraud there has to be intent. Thousands of pounds used to be written off every year where overpayments had occured and yet there was no intent to defraud. More commonly now,you are required to repay at a nominal amount,there are many prosecutions for for fraud but beleive me there are far more which niver get that far,the case needs to be clear cut and iron clad before it will go to court. If there are severe miitigating circumstances (as there are here)it would not be worth all the time and effort involved as it would most likely be thrown out of court.

    it is cruel to let the OP wory about fraud charges when she has so much else to worry about. However, you do need someone going into bat for you and someone who is able to explain in detail, exactly what happened and why,as all the facts need to be presented so that a correct decision can be arrived at.
