will my car insurance claim be refused because i had 2 bald tyres?

I have got a mountain of paperwork to present to a solicitor, and I have pretty good grounds to counterclaim, not least of which was being forced to borrow £700 off my OAP grandad so i could buy a banged up 10 year old car so i could do my 200 miles per week commuting to work.
the Icing on the cake also came when I recieved a notice of county court from the third party claimant asking for £4200 for car hire charges which the car hire company had failed to reclaim from chirchill, and somehow ended up being claimed against me. this i managed to get churchill to take over but sure caused me a lot of unnecesary stress.0 -
It might be worth asking for all of the details Churchill have for you under the data protection act, it will probably though up some interesting information about how they handled your claim0

It's your responsibility to ensure the vehicle is in a roadworthy condition. Because we all check our tyres every morning - don't you?
Whatever you do, don't lose the advisory notice telling you your tyres are NEAR crap - but not crap. Judge will need this to do you, if you bring it to his attention.
15 year old Policeman telling you that your tyres are crap too at the scene?- wash his mouth out.
I don't advocate bald tyres or sh!te cars - but for goodness sake...Reassuringly expensive0 -
Our 20 year old son was an innocent pedestrian, and a car lost control and mounted the footpath and killed him instantly, the car (by the way being driven by an off duty Police Officer) on inspection was found to have 2 illegal tyres. I think its absolutely disgusting that you have been paid out by your insurance company, you drove your vehicle illegally and that is the truth of the matter! I uderstand that your incident wasnt fatal but it could well have been, so why would you expect to be rewarded for your own stupidity, incidentally, the insurance will not pay us anything for the loss of our son, as he was 20, single and quite happily living at home with us (no amount of money could bring him back) the facts are simple, if you drive a car on the public highway with illegal tyres then the responsibility is with you and you do not deserve a penny for doing it, its the likes of honest law abiding people who will in the end have to pay in some way or other for idiots like you.0

If the illegal tyres made no contribution to the incident, then from a moneysaving pov, the poster you rudely call an idiot was right to come here for advice. (And note he already expressed his great concern over the state of thge tyres, and his sleepless nights)0 -

Please do not disrespect my Sons life by calling my comments a rant, he in fact was the innocent party in the situation, he was on the footpath, the car lost control and had bald tyres, so surely you could have some kind of respect.
I would dsagree that the illegal tyres made no contribution to the incdent, as the car should not have been on the road being driven ilegally at the time of the incident.
Yes you are correct this is a money saving site, but surely not to try and wriggle out breaking the law!
I have no sympathy for his lack of sleep, perhaps people who drive irresponsibly would like to walk in my shoes, then understand the real meaning of being unable to sleep!
The fact is he drove a vehicle on the highway with tyres below 1.6mm, that is against the law, and no I do not think he should be paid out for his car although I do think the third party should be covered.
His supporters obiously would never agree with my comments, and to be quite honest I dont care, I am a responsible driver, my tyres are checked on a regular basis, your insurance policy quite clearly states the terms and conditions.
Good for him that he got what he wanted, we will never have that.0 -
