will my car insurance claim be refused because i had 2 bald tyres?

Hi all
I had a car crash on thu last week. I hit a stationary vehicle after losing control on a corner. I lost control of the cars back end and crashed after overcompensating the skid. The police attended and pointed out that both my front tryes were below the legal limit. no fixed penalty notice was issued by the roadside, however I am expecting through the post. my car passed MOT first time round in Nov but i was given an advisory notice saying my tyres were near wear indicator at 2mm. my question therefore is what are the chances of my insurance claim being settled. my insurance is fully comrehensive with churchill, I have had full driving licence for 6 years, and have 3 points for motorway speeding in july 2005.
feel free to flame me for the bald tyres, i deserve it..

check the terms and conditions of your insurance, but as lapat said, they'll most likely refuse to pay you anything0

Was the road wet or dry? Smooth (bald) tyres provide better grip in the dry than tyres with tread."You were only supposed to blow the bl**dy doors off!!"0

I think there's a major risk of non-payment here. And if you get points for driving an unroadworthy vehicle, you will have to notify the insurer of them, and they are obviously going to put 2 + 2 together.0

If they invalidate it they will still pay for the damage to the other car, just not for your damage0

Depends on whether the insurance company finds out...
If you get a fixed penalty notice then maybe you can get the insurance claim settled before you have to advise them of the penalty points?
I had a nasty accident, not my fault though, but my bike was out of tax and I was so worried that the assessor would see and invalidate my claim, but he didn't luckily..BSC Member 155 :cool:

thanks for replies guys.
I am kind of hoping that my insurer will not see the tyres as a contributing factor as i lost control of the back end of the car, but i know they may well refuse to pay up.
if they settle the third party claim then that would be a plus at least, as well as paying recovery costs etc.
i understand some insurers are more picky than others, anybody know what churchill are like in this case?0 -
The OP was not told his tyres needing replacing. He was told they were close to the legal limit.
Whilst clearly he/she is responsible for making sure they don't go below that limit I do sympathise.
OP stated that they were below the legal limit hence the fixed penalty notice expected via mail**Thanks to everyone on here for hints, tips and advice!**:D
