    Also... if they claimed to BE HSBC then I guess it might qualify as fraud? Worth seeing if you can stop it on the grounds that they are not the company he believed he was paying and therefor it's fraudulant? (I'm not saying you can, just wondered if this would come under that...)

  • I would also be contacting the Financial Ombudsman and the Information Commissioner.

    The way this company has acted is intimidation and harassment, which are illegal.
  • If you can stop the payment, then please do so and take up the manner in which McKenzie Hall have contacted your other half about this to every authority that's willing to listen.

    They are con-artists and liars who pay no consideration to the law or legal guidelines within which they are meant to operate.
    Almost debt-free, but certainly even with the Banks!
  • thank you... we had a chat about it last night and I think he feels worse now he knows he didn't legally have to pay it - think he feels v silly and like he's let 'us' down :(

    he's contacting his credit card company in the morning, and also our IFA who helped us set up our mortage (he was v helpful and I'm sure will offer good advice) the shame is - I doubt now he will be able to claim any money back as I was reading once a payment is made, it 'reopens' the debt even if it was statute barred?

    Thank you guys SO MUCH for your kind words and advice, this site really is incredibly supportive for people, and Martin should be so proud for setting it up!!

    found out- a breakdown of incomings vs outgoings...will try to find the time to do this tonight - I've never been able to do a difinative budget...I always forget things, and money just seems to dissapear...oops!

    who should I take this up with though??
    part of me feels it's pointless fighting it - he's paid them now, and theres nothing we can do? :(

    how would we do a 'chargeback'? i.e. what should BF say to CC company when he calls this am? that the debt was statute barred and he shouldn't have paid it?

    looking back with hindsight - they provided no detail of the debt and he shold never have paid - but they were so intimidating he felt he had no choice :(

    Say card details were given only due to threats and illegal harrassment not to mention mis-reprentation and again:
    It is unfair for a creditor to mislead a debtor into believing criminal action or criminal proceedings will take place when attempting to recover a debt. BEING IN DEBT IS NOT A CRIME!

    Hope it helps and let us know what the CC company says. If they can't help then you need to write a complaint to the OFT - If they investigate (which if a complaint has been made they HAVE to do) and find MH have broken the guidelines set out they can revoke their license meaning MH cannot continue collecting money. Would be nice if that happened huh? ;)
