Could you transfer balance the Vanquis to the 0% as their interest rates are nortoriously horrendous.
Anyways welldone for the action plan - why dont you put up your SOA and we can all take a look and help you budget from now till the 0% card

I honestly can't tell you how much of a difference it makes being able to come onto this site and chat about money problems - it makes them all feel so much more beatable and for being debt free to actually be achievable!
By July, I want to be in the position whereby we are actually saving a significant amount of money each month - so if any unforseen costs come our way it doesn't totally floor us...
I'm well up for moneysaving, just hope the BF is too!!

Just read the above and MH contravined every guideline provided by the Office of Fair Trading!! What is not clear though is who I should contact to make a complaint about MH?
I will also check with Trading Standards...

Rog2 made a very valid comnet in response to your entry on another MH thread yesterday.
Under the statute barred rules, the debt still exists, but once you tell the DCA you are not paying, they are not allowed to pursue the debt. If they contact you and you pay, you are stuffed.
Under the Consumer Credit Act, a DCA can only collect a debt if they have the required paperwork. This applies to all debts, whether they are 2 years or 20 years old. And if they cannot provide the paperwork, you can, if really persistant, reclaim the money. Now it is hard work but we have at least one poster on here who has succeeded.
So you may want to send MH a CCA request. They have 12working days +2 days befor ethey default and another 30 before you can pursue them. You might want to contact weller711 by PM and ask her for advice.

It is difficult, emma, but not necessarily impossible. If your BF makes a cca request, to MH, and they are unable to provide a true copy of the original signed cca, then he can request them to refund any money that he has paid. The poster who got their money refunded like that was weller74 I think.
Although as far as I remember that was as a result of sheer cheek and determination in pursuing it rather than any fundamental legal basis for reclaiming what has been paid.
Lack of a proper agreement (like a "statute barred" debt) can prevent the creditor or DCA pursuing and enforcing the debt through the courts, but it doesn't stop it being owed. They are still entitled to ask nicely for payment, and if you do pay then that is up to you. Once you have made the payment, as far as I know it is not then recoverable even through the courts on the grounds that there is no agreement produced.
