    You're on the button: it would be the doctrine of unilateral mistake, and reference to the Kodak and Argos cases was to point out the approach that would hinge on the customer being unaware of an error.

    The irrelevance of the terms has nothing to do with the excuse B&Q are currently using - that's probably come from someone on the sales team and is a bit wide of the mark. As soon as the legal team have to defend any claims, that won't be their reason.

    The point I'm making is that many people here DID suspect an error and that alone is enough to establish a strong counter-argument to any claims. Despite what the numpties on B&Q CS have said.

    You have a point but is it worth going to court over? No. Is it worth a letter? Maybe, but probably not worth investing much hope. If what you're after is a generic apology and a £5 voucher then go for it. If it's anything more than that, I think you'll be disappointed.

  • At then end of the day people, what will/would you be happy with as an outcome? Would you expect to be getting the 'shed', or would you be happy with/to have had some vouchers as compensation for their pathetic customer service and lack of quick contact, let alone for taking people's money and holding on to it so long?

    Personally for me it would be the latter, a gesture of good will which is a bit more useable than 10% off something most couldnt afford anyway. I honestly think its the least they could have done, and for most that would have been the end of the matter.

    It seems that a lot of people posting seem to think we are all demanding the summer house, they are totally missing our point. Every one is p'd off about the way that B&Q have dealt with this. And as pointed out, for such an 'obvious' price error, a lot of B&Qs own staff even missed it, so why would it be so obvious to the purchaser especially when they had not one, but 2 products marked up for the same price.

    If you ordered one and have chosen not to take this any further then thats your choice. But to everyone else who wants to get something better from B&Q than the pathetic dismisive very late letter they sent, with the even more pathetic compensation offer (if thats what it is, though it just sounds like they are trying to get sales. They probably made enough on interest from our payments to cover that discount).

    If people want to persue this then its their choice. Everyone is entitled to their opinion, but if people dont want to just 'let it go' as said so many times then thats also up to them.

    Sorry, but im just getting annoyed by some of the comments. Everyone is free to do what they want to, and the way of keeping up with the correspondance everyone is getting is to keep up with this thread. If it doesnt interest you or is annoying you in any way then dont read it. Is that fair enough?

    Please re-read my post again, and my previous one ? I didn't go for one of these sheds, my posts were a polite way of telling everyone on here who is talking about Trading Standards, Watchdog etc exactly what you've told me !

    It might be just a shed to you - to me it was a way of locking three quarters of my family in the garden, and having the house all to myself. ;)

    Yes, apologies to you, did notice that it wasnt you who was "devastated" after I quoted it! i did hear last night that 1 disgruntled B & Q customer had managed to climb on the top of one of these sheds and was threatening to throw herself off B & Q staff with they're usual standard of customer care turned the lights off and left her too it.

    Agree 100% wait and see but it usually goes like this

    someone finds the misprice
    everyone orders the misprice
    some plank rings up and gives the game away:mad: (not naming any names you know who you are!)
    everyone x's their fingers in anticipation
    wild rumours abound the forum
    company cancels orders
    everyone then becomes a legal expert
    threats of legal action and suing the company which then leads to......
    b*gger all(apart from a little "devastation"!) and much gnashing of teeth and cries of I'll never deal with (enter company name here) again.
    2 weeks later die hards are still waiting on a miracle
    someone finds another misprice..........
    and away we go again!

    Though I was *really* devasted when me table tennis table that didn't turn up !!!!! ;) Well, more so for my kids who were so excited ( and as I was putting them through all the grief of their parents seperating at the time, I thought it would help ! )

    I now have a happy life, despite the lack of table top games :D
