I ordered on phone to local store on Saturday morning, sales assistant said item not showing on web, so he ordered via B&Q stock system, confirming price of 357.11 Was sent order confirmation and receipt in post, but I had a better bargain!!! as local store had been refurbished, i was given an extra 10% discount, so with delivery paid only 341.40!!!
I have heard nothing since, except refund to cc this morning.
I called store to be told by deputy manager that item has been cancelled due to a "Quality Problem", I asked for replacement model GR2 instead, he told me this also is unavailable (2 blatant lies) as i can order GR2 myself now, on www.
I spoke to Palladium for confirmation of Quality problem....lady there, Carol tells me not true...due to a mis-price by B&Q! However, she said that they had received 230 orders on Saturday for garden room GR3 -
so we now need 230 customers to contact B&Q complaints department/Trading Standards/Watchdog........
dawnp, I think that your case is stronger than ours and they are lying to get out of supplying you with this item - pursue it further and fight them - as for the lies:mad:

I think all our cases are strong, as we all equally paid out for this product, and we must all stand united against this, as we know, B&Q took orders from the net/phone/in person for the same product, effecively entering into a contract with all of us. (230 Garden Offices at a price of £370.11 = £85125.30)
Rb1947 is quite correct, everyone must speak to consumer direct and outline the case concerned, then follow this up with a recorded delivery letter to B&Q stating that they entered into a contract and B&Q are now in breach, and suggest they honour this contract and give a time window of say 14

Have just called Consumer Direct who have logged it, however did say that unless the item was despatched it could be cancelled at any time prior by B&Q. And that my query would be passed on to Trading Standards

I did quote the Terms and Conditions when I rang CD and as I such I was told that the contract was formed when B&Q accepted my payment.

Not very good at letter writting, is it possible someone could draw up a template so we have all the details to send to b&Q. Especially regarding different prices at different months etc..

I personally wouldn't bring the different prices at different months into the equation as this will just muddy things.
The pertinent points are that two separate items were advertised in their "sale". I purchased one of them and had an order confirmation and money exchanged hands. Their own terms state that the contract is binding once payment is taken and not on despatch of the said items.0 -

I would start with Consumer Direct firstly - the form is very easy to fill in.

Then try Watchdog. By all means try B&Q as well, but I think you are better off with CD.
As for what to say... here is a summary of my form to Consumer Direct. If you contacted B&Q to confirm details add this in along with any other relavent information which may be important about your order.....
I purchased the item Palladium Garden Room Model GR3 via the B&Q website. This was shown as being part of their ‘Big Sale’ with the correct price saving shown and was priced at £357.11.
Email confirmation of the order (which confirmed payment had been received) was sent by B&Q on Saturday referring to the ‘contract’. Payment has been taken from my credit card for the full amount.
I had no further contact from B&Q until Thursday, when I received a letter stating that they were cancelling the order due to an ‘obvious misprice’ and quoted ‘reserve the right not to supply you at our discretion’. They also state I can reorder the item at a higher price.
I’m concerned firstly in the time taken for B&Q to inform me of this ‘obvious mistake’ and the apparent breach of contract.
Their T&C’s state "Ownership of the goods shall remain with B&Q and shall not pass to the Customer until the agreed price for them, together with all other sums due from the Customer to B&Q, have been paid in full.". So it appears that everything had been ok with my order as it had been accepted.
The term about ‘right to refuse’ appears to be an unfair term of contract as it upsets the balance of contract in favour of B&Q. They say that it was a regrettable but obvious mistake, however I do not think it was obvious as the product was advertised at the same price in two different colours (separately advertised items) and it was part of their 'Big Sale'.
Please can you advise on my position in this matter.
