Kays price error on DC07?

            Ive no doubt it will reapear in stock in a couple of weeks of course by then its too late.

I think most of us are believing that Kays have simply been messing us around, the stock excuse is just a standard 'we made an error' reaction and undoubtedly, were you to want to pay full price, they would be able to get you one. I have had bad experiences in the past with these catalogue type people, the more i try and get stuff from them, the less i feel happy about it!

            ***UPDATE ON KAYS DYSON DC07 ANIMAL***Like alot of people that ordered this Dyson DC07 from Kays, the order was cancelled without even informing us. I have received a letter from amanda.hollingsworth@shopdg.net saying that my complaint was being delt with a member of the director's office team

I also Email Dyson to tell them about the problem and they told me they do have the Dyson DC07 Animal in stock, very

I have now received a reply from vivienne.coulson@shopdg.net, she said that even though Dyson have said they have stock of the DC07, it does not mean that they have stock available for kays on there agreed T&C, its funny that as I did mention to Dyson that "Kays" said they could not get stock form them. Kays buyers have been advised that they cannot obtain any further stock?. I think what she realy means is they cannot make any profit if they buy them in from Dyson, I have also asked Vivienne by return, did anyone get the Dyson for £107.00? as I don't know anyone that did.
So come on all you new Dyson DC07 Animal owners tell me I am wrong.
I don't understand why Kays won't admit that they have made a big mistake and are using there T&C to get out of it :T .
I have told Vivienne to look at the site "I don't think she will though" so now its time for all of us to let them know what we think of there get out clause.
By the way there is another Dyson DC07 on there site now, but it shows "in stock in 3 weeks" like the Animal did. Does that mean its not worth buying as they won't get any stock :rolleyes: ?. I don't think so because its over £200.00.0 - 
            Surely their terms and conditions aren't legal? If you go into a shop, and they realise as you are go to pay that they have priced something wrongly, they have to sell it to you at that price, yes?
I think you should all contact trading standards about this.

            I frequent 3 forums where this offer was seen and widely taken up..... NOBODY has reported that they got one. I would bet that you are absolutely spot on, but i doubt Kays will ever admit it!

No, A shop can refuse to accept payment for an item that has been mispriced. The cotract is not formed until payment is actually 'accepted' by the vendor. That means you can't put the money down on the till and insist you have paid, the assistant must actually accept that payment.
The pricing of goods and the fact that it is 'an invitation to treat' only is basic law.
Of course, that doesn't mean that many shops won't just let you pay anyway, larger shops particularly rely on good will. I recently bought some T shirts in Littlewoods stores marked as reduced to £3.50 from £5. The till showed them to be £5 and when a manager was called he said they had been mispriced by a junior staff member and were new stock and not part of the sale promotion. However, he let me have the ones I was holding for £3.50 but sent someone to remove the rest from display immediately. He would hav ebene within his rights to refuse to sell me them at all.

            HI ---HAd the same---out of stock issue.
Someone tell me if I am wrong---A webpage----can be taken as an advertisement.
Therefore Kays advertised the product---but has failed to deliver----so can we complain to the advertising standards agency---this is an online form.
If a large number of us do---them maybe ASA will make Kays take note.
What do the others think? Is it worth pursuing?

            The ASA will NOT intervene in an online offer situation. They say it is outwith their jurisdiction. If you saw the same offer in a Kays catalogue however, they may be able to help then, but not if it was just online.
I have a letter stating this from when I had cause to fight against another online retailer under a similar circumstance.Herman - MP for all!
