    Can I ask the people that have definitely been let down, have you had any written confirmation from B&Q other than the email? Just wondering as I have received a sales advice slip today from them.

    well I've had written confirmation as well but I'm preparing myself for a let down judging from whats happened so far.

    1. Order Date/Time : Saturday 16th July about 13:00
    2. Confirmation email Date/Time : Saturday 16th July 14:13
    3. Card Charged Date : not sure yet (no bill from Visa)
    4. Promised Delivery Date : Friday 29th July
    5. Actual delivery date : Friday 29th July
    5. Items ordered : Table Tennis Table + Football table
    6. Items outstanding : TTT
    7. B & Q's response : I kept having to chase. Sorry but supplier stopped making them. We cannot source anymore.
    8 Any further action? : Put on BBC WatchDog site, they called back, but expected me to be happy with football table!! I bought this on a whim just cos I was happy about TTT purchase foir kids.
    9. Any other relevant info : B&Q, DIY.com, couriers - who's who, all blame each other, and all deny that a real time system can work online!!!

    Hope this helps, not sure where to go from here as B&Q say refund on way now. Any help please much appreciated. Cheers

    just had a call about my swing set.
    firstly all i got was an apology,them when i quoted the sales of goods act things changed slightly,i was then offered £30.00 (maybe more) from head office if i can find a simalar item elsewhere.
    ive been given the private number of the person dealing with my complaint and told to contact her once i reach a decision.
    i was also informed that trading standards have already been in touch.

    i know that this is a very annoying situation and that b&q should stand up to there misatke and amke good on the offer, but at the end of the day it is only a climbing frame and isn't a matter of life or death. if anything like my kids they are on to the next new thing within a matter of days anyway.

    i do hope that this post isn't takien the wrong way and whilst i do sympathise with you all and agree that b&q are out of order some of us seem to have lost sight of the problem. B&q do not care about what our children think of the situation, they will just be trying to minimise losss to the company and i personally feel that any complaints should be addressed in a more 'you have not fulfilled your obligations' rather than an emotional repsonse.

    p.s i too have not had some of the things i ordered delivered

    Only had my confirmation email back on 15/07. The only other hard copy I have is the delivery note from B&Q stating two items delivered and a third awaiting stock.

    Now that they are ignoring my calls,I've written to them instead so now they can't ignore a signed for letter with specific request to fulfil their legal obligations.

    Just as a by the by for those who did actually get a playcentre and ordered a tyre swing to go with it.......ours has been up for exactly 1 week and the rubber has torn around the area where the tyre joins to the rope.

    Might be worth keeping an eye on yours if you got one.

    Going by the posts here now, I'm not going to hold out much hope for a replacement.

    Just had a response from consumercomplaints.org - sounds like we are definatelt covered with loss of bargain. Can anyone confirm for definate if the table being sold by Argos is exactly the same?

    Many thanks for the advice. I have heard of the loss of bargain which I assume needs to go through the small claims court. The table purchased is available elsewhere (the exact model) at a much more expensive price (Circe #300.00 more). I know I am not the only one affected by this, and you may have had similar queries from other members of the public who are intending to pursue this.

    Please could you advise how I proceed with the loss of bargain through the small claims court? Is there a web site or information freely available on the process I need to go through?

    The enquiry you recently made to consumercomplaints.org has been forwarded to this authority for advice to be given.

    From the information supplied, I would agree that when you placed your order online and made payment, you had entered into a legally binding contract with the retailer. However, they have breached that contract by not being able to supply the goods in question, so effectively they are in the wrong. The remedy for this breach would be a refund of money, which, I understand has been offered.

    In these circumstances, the law wouldn't automatically say that a consumer should be entitled to any additional compensation for the breach, but there is a common law principle called 'loss of bargain' which you may try and use.

    If you were able to purchase the item (which must be identical in all
    manner) elsewhere and you have to pay more than you originally paid, you can claim this extra amount as 'loss of bargain'. Although, I must say in all my years as an advisor, I have never known any consumer to effectively use this provision as it is usually very difficult to obtain a comparable item.

    My advice in this situation would be to take the refund.
