    This is a perfect example of how people are treated differently by the same company. I had an agreement in writing from Goldfish last sept '07 agreeing to my DMP payments until sept '08 & everything has been fine, then this week I got a final demand letter & when I called them to see what the problem was they told me they have sold the debt on to Cabot. They were as arrogant about it as is humanly possible!!

    The other problem with a charging order is if you want to remortgage. I was told that if your fixed rate mortgage comes up for renewal & you're lucky enough to get a better interest rate (so want to switch providers), that even though you're not asking to increase the borrowed amount you would still need to pay off the charge. Obviously like in my position if a company does get that order it would put an extra £11000 on my mortgage which would cripple me financially.

    Without knowing much may I recommend you take the time to read the following link and see if they have broke any of the guidelines, if they have send a recorded delivery letter to them marked clearly at the top with "FORMAL COMPLAINT"

    It could be they are just trying to scare you, I honestly don't know and to be honest only they know what they intend to do. What I do know if you can get in first with a good letter of Formal Complaint you could force there hand into dealing with you more fairly.

    Payplan have said they don't deal with KPR, they never said why.

    Payplan are aware of KPR, but don't deal with them, I've sent Payplan the letter I've received from KPR, Payplan said they cannot action on it, but will add it to my file.

    I must say, I'm very happy with the help and advice I#ve received from Payplan whilst dealing with my DMP, but this has thrown me.

    I asked Payplan what do I do re KPR, payplan offered no advice.

    I'm sorry for the delay in replying, I'm unable to access the forum from work.

    I'd take a chance & go in with a 20% offer as you still have a lot to play with, & as I say they came to me at the end so you must stand a chance of them accepting.

    Usually Nationwide's first move is to pass the debt on in house to their recovery department. Have they already done that or have they skipped that process??

    This a/c that has been passed to KPR is my current a/c which includes my overdraft.

    Nationwide have gone through the default notice process with me.

    I do have a Nationwide CC, which strangly has been passed to a Company called Viking, I have forwarded that letter onto Payplan, Payplan have said they will deal with Viking.

    No offence, but I'm not surprised I'm becoming confused.

    That is what I meant for you to read through see if you can find anything they have done wrong to complain to them. If you do find anything make sure its a "formal complaint" sent recorded delivery.

    In the letter state what you want clearly for eg, you to accept my DMP offer with Payplan and suspend interest and anything else you want like a refund etc depends basically on what you find they have done wrong.

    Yes I did, Payplan asked me to keep a log of all the contacts I have with KPR.

    I have explained to KPR, as far as I'm aware Nationwide have accpeted the offer from Payplan, the **** at KPR said Nationwide have no right as they are no longer dealing with the debt.

    Thanks for the link, I forgot to ask you to post it, as it was not in your original post, never mind, see how stressed I am.

    Anyway, is the link above the same as the "Administration of justice act 1970"?

    In reference to THIS debt, this is one of my lowest, i.e, this balance is well under £2000.

    I'm in the same position as you although Nationwide haven't yet passed this on to KPR, so I await this move with sheer excitement. Apparently it will happen within the next 6 days.

    Will be interesting to see what happens because I've told them I'm starting the process of claiming back the unfair charges (I'm aware this is on hold at present), however should the banks lose they would actually owe me money so effectively I'm putting the debt into dispute.
