    You may be able to help me or anyone else who can i have been trying to get the answer for my sister ,i tryed to post on morgage forum but knowbody seems to know .

    My sister may be having her house repossed (very vague at the moment she is reluctant to talk about it ) I know she has a date when she has to be out will she have problems getting a councel house or a private house because of this ? What happens on the date that she has been given to get out of her house does somebody from the morgage company come round on that day to make sure she is out ?

    I wish i could have made her look at the website i think it would have helped her with all the great advice i have been given but she has buried her head in the sand and just kept spending .[/quote]


    Sorry Carlos, I don't actually know too much about repossession,as this is a litigation/debt recovery process and i deal with conveyancing only, but I do know that there is a process. How far behind is she with the mortgage and has she made any attempt to pay arrears etc, or can she not afford anything? I have seen another thread on DFW forum - i think it is headed "being evicted today" or something similar - have a look at that and see what advice was given. That thread seemed to say that the council couldn't (wouldn't?) help.

    If an order for repossession is granted, i do beleive that bailiffs instructed by the mortgage company will turn up on the day to evict her if she has not already vacated. Is there any chance she could sell the house first?

    Carlos - I used to work at an Estate Agents and we used to take on the odd repossessed property. Most the time we would get an appointment to go and people would have left. On the odd occassion as our valuer went out the family would be just leaving. There was always someone there not sure if it was from the mortgage company or representing them and the police can be called to remove people.

    Very sad our manager used to hate it.

    I hate sitting on the bus to get home from work sometimes - it gives me time to think (and worry!).

    It's just occured to me that it's April next week so I thought I'd check my Child Tax Credits. Based on a letter I got from them with my final award back in June last year, we due to take a £30 a month drop in payments. But, it gets worse.

    I've just got a pay rise, which was backdated to April last year, so I need to advise them of that.

    OMG - This is an unknown amount, but added to the increase of £17.50 for council tax, gas and electric, I'll have to drop my payments to my creditors.

    Will this never end?

  • Good morning folks. I hope you are having a good start to the weekend.

    A letter arrived from Nat West this morning, threatening us with all manner of things as we haven't made contact with them! ARGH! OH has spoken to them on the telephone approximately 6 times in the last two weeks and I have sent around 4 letters. How much contact do they need!

    Why do these letters always arrive on a Saturday morning?

    Anyway, I've just had 4 chocolate digestives to consol myself :)

    Did your hubby use a mobile or landline that itemises bills? Just a thought but you could then claim they are harassing you if you can prove you made the calls. You could claim that anyway and say you have an itemised bill.

    Stick with the biscuits and file away any worries till a business day - its the first proper looking Spring weekend so officially you have to chill!

    Regarding CCA requests its your own choice. If companies have been good with me I just get on with paying them through the CCCS, I only go the other route when they start on me.

    If they don't provide the CCA within the 12 working days you can stop paying them as the debt is officially in dispute & is unenforceable unless they can get a judge to enforce it (unlikely) or find the paperwork. I requested mine with a statement of account because I wanted to see the charges that Weightmans had put on, they still haven't provided me with anything. I haven't stopped paying them yet because it's heading for court, but if they go over the 30 days then they won't get another penny from me, unless the judge says otherwise.

    If an organisation like HFC etc sell on a debt (at a vastly reduced rate) to a DCA then for the most part its because they don't have the correct paperwork. If they did they would just get their own legal department to take you to court & recover the full amount not just a fraction of it. Obviously this isn't always the case so don't bank on it.

    If you do go the CCA route, make sure you report them once the time is up because otherwise they'll sell the debt on again & you'll keep going through the same process with other DCA's. This CCA 1974 doesn't cover everything such as overdrafts, it's only for loans & running credit agreements & as somebody said it doesn't cover things over £25000.

  • rayday, thank you. He used his mobile phone but he can get details of the calls, so that is very handy. Also, although I keep copies of letters I send, I will post them Recorded Delivery from now on (more money to spend, but worth it if I know the letters are being delivered).

    It's nice and peaceful today although the wind is blowing and the rain is coming down in huge bucketfuls! OH is working (overtime) and I am doing my business accounts, but having eaten the biscuits I found a bag of Fruit Gums at the back of the cupboard so I'm now chewing on those (mind you, my teeth aren't what they used to be!)

    geoffmr1 - thank you very much indeed :) The whole CCA business is quite confusing as there is a wealth of information online and so much to take in.

    I think, for now, I will not request them and see how things go (although we are starting to get some legal mutterings from a couple of the creditors).

    I was aware it did not apply to overdrafts. However, OH has a loan with Nat West which is currently around 16,000. Can we CCA this do you know?

    Hi many of you know i have done my dmp and i HAD 6 creditors BUT today a letter came to my next door neighbour at my old house (old house is where my ex lives so he passed it on to me) the letter is from united utilitys and its from my previuos address b4 the one i lived at with my ex (if that makes sense) and is for £188 and i need to ring them before the 2nd..what do i do? do i ring cccs? i cant afford to pay it.
    Sealed Pot dec 08 - dec 09 so far £27.67, Live off £4k Spent £330.20 GC £1,200 for 2009 Spent £50.78 PaD so far £650.07

    I have only requested CCA twice, (first time I had two DCA chasing me for same debt) because to be honest I don't get peace of mind from it. I have asked in that "request your CCA topic" and I get ignored. But mine were both for catalogues one said we don't have it and passed it back to original creditor - now with catalogues all the proves I believe is that a DCA cannot take it on so now I feel I have 6 years waiting for the original company to get in touch - so where is the peace in mind in that?

    The second one I requested I am posting the final letter out after the 12+ whatever it is has passed. Only reason I went this route with this company is that they were saying I had missing payments (which I hadn't) and it was going to cost me £5 per cheque to get copies and the CCA only cost me a £1.

    I am like Geoffrey if they happily take payments I want to pay companies and I definately don't want to complicate my journey further. I did take finance out and bought things and believe I should be paid just not ripped off!

    How long ago is it? If you definately know it is yours and can't afford to pay it then yes seek CCCS advice - probably only end up with about a £1 I should imagine on that amount depends what your overall debt is and how much you pay a month.
