now i never recieved any email on a cancellation.
i wouldnt really have a problem if they had cancelled early on even if payment was taken. however waiting 3 weeks to take payment after chaging the delivery date and then not bothering to tell me its cancelled is another matter0 -
Im going to email now as I agree they kept sending change of delivery emails and then to take payment now is taking the mick..Bit of a Florida Fan :j

They're being mislead by you! If your so sure on what your saying find a link to a case that demonstrates your argument, an exact case! I bet you can't!
Why do I need to bother trawling google to find a specific case?
This is basic contract law. I suggest you go and look up items such as "communication of acceptance", and then tell me why the Dell T&C which states that the email order confirmation is not the acceptance that their T&Cs state.
Or perhaps you would like to explain why something being out of stock constitutes Force Majeure?
Or maybe even why you think that a binding legal contract can be voided simply by refunding the customer?0 -

Dell will try and put you off, telling you that your order has been cancelled and you will need to speak to Sales to re-order.
Don't let them put you off. Draw attention to their T&Cs, plus the fact they took payment and insist that they have to supply you the agreed for goods at the agreed for price.
If no joy, then involve your local trading standards.0 -

By the way with regards to your contact Trading Standards remark above, they will not be impressed if you have your money back! I know, I've had these sorts of conversations with them.0 -

tbh i would have let it slide without a thought if i had got the cancellation email.

We did try to see if an alternative could be sent but the suppliers have informed that there is no alternative available at the moment.
It might be due to a technical error that the web is still not updated.
We have escalated this with the online team and they are working on this, and would get it rectified.

ive replied they have both a cushtop and case on the dell site with available in 24 hours.
plus another colour of cushtop on 3 weeks despatch.
now im assuming for something to show 24 hours despatch they would hold stock on these?0 -

This isn't personal opinion, this is basic contract law. Why am I wrong?
Can a contract be voided by refunding the customer?
Is being out of stock force majeure?
Why despite Dell stating that order confirmation constitutes acceptance, do you insist that there is no acceptance or contract?
