can dell do this

as posted, ordered some great dell bits, laptop beg etc, received confirmation by email of order, and later on a couple of occasions revised and amended delivery dates. now have just received
Your Dell order 2163**** has been cancelled
Because of a problem with the combination of components we cannot complete the order.
If you paid using a credit card any authorization will expire within 28 days.
For other payment methods we will arrange a refund within 2 days - however please be aware it may take a few days for your bank to clear the payment.
You can place a new order online at www.dell.co.uk, or by calling Sales on 0870 906 0010.

I thought if they confirmed then they were obliged to complete the order. help please after being strung along am v miffed they have tried this on. thanks

    Yep annoying but perfectly allowable - from a service point of view I think it would be nice if they used the word sorry in the email though!

  • I think that you will find that they only consider there is a contract when the despatch mail has been sent. I think you will find most online co's do this. I found this when I was trying to take advantage of one of their missprices and dipped out.

    Look at Dells own terms and conditions.

    Refer to their T&Cs, items 3.3, 3.4 and 4.1.
    1. 3.3 Dell accepts Customer's offer to purchase under this Agreement & makes a binding Agreement by issuing an Order Confirmation. Order confirmation is binding except, in the case of consumers only, where there is a discrepancy between order confirmation and what consumer ordered and where discrepancy is unacceptable to the consumer. It is recommended that Customer review the Order Confirmation & notify Dell within a reasonable period of time of any discrepancies that are noticed.
      3.4 Dell reserves the right to make changes to ordered specifications but will identify any such changes in the Order Confirmation. Dell guarantees that any such changed Products will offer at least equivalent functionality & performance. Dell will not make any significant variations to Products or Services without Customer's prior agreement &, except as provided for above, will manufacture & deliver Product in accordance with the Order Confirmation.
    2. Price and Payment
      All Customers: 4.1 The Price that Customers have to pay will be shown on Dell's Order Confirmation and invoices.
    If they have sent a confirmation, that is a binding contract, and they are legally obliged to send equivalent or better alternatives for the price agreed to.

    What if there was no equivalent,in that case ,what could they reasonably be expected to do?
    Its common sense ,surely?

    But I think you can also add "cancel and give your money back" to your list of things they can do!
