My advice, as I have advised so many others on this thread to do, is to visit www.taxcc.org and copy and paste the same post on their forum. There are forum members who can give detailed advice about tax credit overpayments. From what you say in your post, then I think the "income disregard rule" should apply in your case, but I am not an expert and you do need someone with more knowledge than me to advise you.
I would say if you can't afford to lose the child tax credit and you feel that it is an HMRC error, then you should dispute it. If you don't then you are just another unreported wrongful overpayment and the system can only be changed if the number of people affected puts pressure on the government to effect a change.
Whilst in dispute your repayments towards your overpayment should be suspended so your current claim should start in payment again although you may need to insist on this and explain the rules to the Helpline! The TaxCC site tells you how to submit a dispute.
There are no guarantees of a successful dispute however in a statement from the Financial Secretary to the Treasury Steven Timm’s MP said:
“If .... Constituents have informed the tax credit office of errors on the award notice and if those errors have led to an overpayment, that overpayment is not recoverable. If you would like to draw my attention to any examples of that kind, that would be the outcome”

i have just recieved a letter stating that i owe nearly £4000 in overpayments from 2005 but i was unaware that i even got any tax credits in 2005 and evertime i phone them i get a different story from them. i feel as if i am hitting my head of a brick wall. i am really worried as i dont know who i should turn to now

i have got a query regarding my tax codes its so confusing hope someone will tell its all about.my tax code is changed from 647L CUMULto 366L NONCUfor tax year 2009-2010 as it seems i have underpaid,moreover i have second job which i work approximately 7.5-30 hrs (not every week) which was on tax code of 647L and that will be changed to BR.My query is will this tax code change next year or do i have to ring and tell them,and whether they taken my second jobs tax code incorrect in first place.

Has anyone ever had their credits suspended without any notice whatsoever?
My payment on Tuesday didnt go in so I rang them and they said it was a technical/computer error and would be sorted.
Three days later still nothing and no one will tell me anything and my payments are still suspended!
I am sick with worry, I am not eating or sleeping and just do not know what to do!0 -
I finally took my head out of the sand after avoiding wanting to deal with this but eventually thought ive got to at least send off my claim form get things on the move and then see what happens and take it from there.
Does everyone else feel the just as awful as me? and dont you just want to shove the letters in a drawer because you cant face the thought of seeing another demand for overpayment???
I really feel for everyone and hope that we can all stick together and give each other support to get through this.

Yes totally agree with you! i had a change of circumstance a year ago and told them inwriting and later on phone. I got 25 diferent leters al ayng diferent thin gs and I was very anxious every tme the postie came for about 3 months!!!
They kept saying i wored abroad and only had one child WRONG i work pat tme in uk and two kids but tr telling them. Al they had to do was check with child benefit people but no I had to send copies of child benefit stuff!!
The tax cedit dept should be sorted asap.
This year I have no change of cirumstance same kids same wage etc and they pay me a lump sum of £1k then ncrease my payemnst by £150. iBut no leter to exlain. So i am keeping the exra for when they ask for it back!!!0 -
i was claiming ctc for my three children as a lone parent then i started seeing someone and after a year or so i feel pregnant just before i was due to have my daughter he moved in so i canceled my claim for income support and as he wasn't working at the time we tried to start a claim for jsa which took some time as they said they didn't receive three forms we sent in (during this time i had our daughter) anyway the adviser at the job center had told us not to tell ctc just yet as we needed proof of jsa and my daughters birth certificate plus they would cancel it straight away meaning we would have to live on child benefit alone which at the time was for three children so it was impossible to live on that alone so we waited until we got the letter from jsa and after the baby was registered i then rang ctc and they stopped my claim there and then and sent out a new form which we completed and sent straight back this was 6 weeks after the changes but i stated in the form i needed the ctc backdated to my daughters dob and any money outstanding for the other three during the period of them canceling my lone claim and starting the joint one but after a couple of weeks my then partner finished the relationship so i rang ctc and told them the man on the phone said that they had received the joint claim but wouldn't process it instead they would wait for the new lone claim form they were sending out that day to be returned so i filled it out and sent it straight back including all the info on the changes and what money needed to be backdated and for what periods i then noticed they hadn't backdated any so i rang them and they said they wasn't sure if it could be backdated as by this time it had gone ova three months but the lady said she would pass it on to the manager and i'd receive a letter in due course i had the amended ctc letter showing the backdated amounts but i have now received a letter saying i owe them £1148.27 which i'm now not sure who's fault it is theirs or mine as i took me a little while to tell them of the changes but i did clearly state at least twice when it need to be backdated til and also who for but it looks like they backdated all the money to my daughters dob even though i told them it was just the baby that it needed to be backdated to that period for plus they would have seen on their computers that they had paid me for the other three for that period any ideas who's fault its classed as??? cheers0

I suggest that you copy what you have posted here and go to http://familytaxcredit.forumco.com/, and post exactly what you have said here in the New Members section of that forum. That is the forum for Tax Credit Casualties (www.taxcc.org) which is an organisation set up by people who have had their own problems with tax credit overpayments and who try to help other people who have problems. There are forum members there who know alot about the rules and guidelines and can give you some help.
I would also suggest that you have a look through their website, www.taxcc.org, particularly the How to Dispute section so that you have some idea of what you need to do - you will have to submit a dispute form initially and this will mean that any demands for repayment will stop while the overpayment is investigated. Don't panic though, because although it does all seem very daunting at first, there are forum members who will help guide you through the process.
Take a deep breath, and go for it. Unfortunately not doing anything will mean that the problem will get worse so although it is hard work, unpleasant and stressful, you do need to get this sorted. Unfortunately there is no arguing or reasoning with the tax man (or the debt collectors)and so you have to go through the proper dispute process to get things sorted.
I will let them know at TaxCC about your problems and so hopefully someone will be looking out for your forum post.
