Hi, Its difficult to properly advise on this one cause I dont know the full situation, however:</p>If you claimed at the end of 2005, then the first declaration you should have had to do would have been at the end the 05-06 tax year, and the payments that year wouldnt have stopped until after the renewal period, this would have been September at the earliest, so if the payments stopped after a couple of months and your claim started in 2005 then its not cause you didnt sign your declaration.
If it is because of the declaration then you need to complete the dispute form(COP26/TC846) stating that you were entitled to tax credits, you should have got another claim started straight away, and that will prove your entitlement
If it absolutely does have to be repaid though, ring the overpayments helpline (08453021429) and they will look at your circumstances with you, and arrange an affordable repayment plan

In response to JILLD</p>Hi, With regard to the overpayment, the normal helpline needs to tell you that, not the overpayments line, the normal line needs to look at your household account and then they can tell you
With the employer change, they dont need a PAYE ref, just ring with the new companies full name, address and telephone number and that will be enough - if the advisor insists on a PAYE ref then ask them to check their guidance, speak to their manager if neccessary, and make a complaint against the advisor/manager, because it is possible to make an employment change without the PAYE ref.
Finally, on the childcare, if the drop is less than 10pounds then it cant be accepted, so in the off chance yours is, then dont worry about it!0 -

Newbie here.
Y do they make it so hard to appeal a decision?? I have contacted department four times now to request relevant form to be sent and still no form! They are telling me i owe close on 2 grand from joint claim in 03/04. Annoying thing is they are able to say that I provided all my details but other half (waste of space!!) didn't. I am apparently now liable to re-pay whole amount...So not only have I been left with all the 'joint debts' etcetc I now have this to add to it!!#
Sorry for rant, to be honest its made me feel a bit better knowing I'm not the only one having such problems with them.0 -
Hi Ronnie, just ring up and ask for the leaflet COP26 which has the dispute form TC846 at the back. You arent fully liable, you and your ex are jointly liable to repay this money, if it comes down to the point where you have to pay, just ring the overpayments helpline, and say you are willing to repay your half of it and they will be able to arrange this for you0

my husband was claimin tax credits for me as i am disabled and when he first enquired about it was told yes he could claim.mistakes where made on the forms we got back so we phoned to amend them.luckily we kept dates time etc.now they are saying we WERE,NT entitled and we have to pay it all back wait for it,£IO,000 .as you can guess we are appealing.what a nightmare.0

Legally they can make one party repay it all, but it is better if you make an offer of payment rather than them chase you.0 -
Well I hope they don't want any money back from me, if they do I will pull the tiles off the kitchen floor and scrape the paint off the walls and send that to them. :rolleyes:0

thought i would just update by saying 16 months on am no further along. keep sending complaint forms and keep being told as you have given no new info our decision is the same. they are still saying i did not inform them of my marriage until a year later, which of course is not true. £4500 of this money was paid into account in one month and when i rang to query it they said i was owed it from previous years and now they are saying i was paid too much that whole year as i was still being paid as single. i cant keep going on ignoring this and hoping itwill go away and filling forms is getting me nowhere. so i have now written to them to say that although i have received this money it was their error and not mine but that i am not denying i received the money. i have said i will not be responsible for paying the whole 100% but expecxt them to come up with a figure that would be agreeable to us both and over a suitable amount of time. so now have to see what they make of that!!!!!
finally received the same reply,as i have given no new information i am and should have been aware of being overpaid i still need topay. now though they have said i should have informed them that i received incapacity benefit which is taxable benefit which i did not know. they said i owed them approx £3500 for last year and instead 0of getting my usual £265 per month i would now be getting £220 per year!!! and this would be taken by them to go towards that £3500. two days later i received another statement saying it was not £3500 but £5500, no reason for increase but i assumed must be due to the same happening the year before. then i receive another statement saying i owed £9900 i rang to ask why as i was not receiving the year before that as well and they said they would send out a statement detailing it all but that it would take six weeks. i cant believe they are now chasing me for this plus the original debt of £8900 from 2003 when they say i failed to inform them of my marriage (which i did). i cant believe i now owe them nearly £10000. i did originally go to the peoples right for advice and their letters just got the same replies as mine and when the third person took on my case he said there was no more they could do now besides take them to court. i cant afford that and am so out of my mind with worry about the whole thing. my husband says worry about it when i need to as they are not asking for this second lot of money yet as they are taking it off my £220 a year award but will only qualify for that for anothe 2 yearsof my sons college then they will hit me with that too minus two years of taking my annual award of £220. it is going to be really hard managing on a drop in money form £265 a month to £220 a year and i dont know what to do now can someone please give me some advice i cant bear it anymore. i am disabled and so have lots of time on my hands to worry, PLEASE where do i go from here?0
